Can A Realtor Add A Name To A Deed? | REALTOR.com? Blogs

Q: Can a Realtor fill out the documents to add a name to a deed or does it have to be done by an attorney? We purchased the home in my name and credit score only, about nine years ago. We want to possibly try to refinance the property in his name through the VA. This may be redundant since we?re somewhat under water on the original mortgage. I?ve heard that I can fill out the paperwork by myself, but prefer to have a professional handle it. Thanks for your attention.

A: In most states, there is more than ?paperwork? involved in transferring title to real estate. You would need to use an approved form of deed, it would need to be recorded and there might be a tax payments required (although usually a transfer to a spouse is not taxable). This would not be something a real estate agent would want to take on. Also, you might want to remain an owner for other reasons. Best of luck!
