Supreme Court to take on gay marriage

The Supreme Court is poised to take the bench today and begin the second half of a term laced with hot button issues such as affirmative action, gay marriage, voting rights and government secrecy.

The justices will hear two potentially blockbuster cases in March concerning gay marriage. One of the cases - Hollingsworth v. Perry - addresses whether there is a fundamental right to same-sex marriage. The other - Windsor v. United States - deals with the federal law that defines marriage as between a man and a woman.

In both cases, the court will hear arguments on potential procedural obstacles that could stop it from getting to the core constitutional questions.

The court will also hear a case challenging a key provision of the Voting Rights Act. Section 5 of the law says that certain states with a history of voter discrimination must clear any changes to their election laws with federal officials in Washington. Lawyers for Shelby County, Ala., are challenging the constitutionality of Section 5. The case, called Shelby County v. Holder, will be argued Feb. 27.

The day before, the court will hear arguments in Maryland v. King, a case about whether Maryland officials can collect DNA from someone who has been arrested but not convicted of a crime.

The justices are already working behind the scenes writing and reviewing draft opinions for cases they heard this fall.

Fisher v. University of Texas is a case that could further limit the use of race-conscious admissions policies at public universities. The case was brought by Abigail Fisher, a white student who sued the University in 2008, claiming she had been denied admission based on her race. Justice Elena Kagan is recused from this case, presumably because she dealt with it in her previous job as solicitor general.

They are also considering a case closely watched by human rights groups and big business that addresses whether corporations can be held liable for alleged violations of international law under a federal law called the Alien Tort Statute. At oral arguments, a skeptical Justice Samuel Alito questioned why the case was in the U.S. courts in the first place.

"Why does this case belong in the courts of the United States when it has nothing to do with the United States other than the fact that a subsidiary of the defendant has a big operation here?"

Several human rights groups want to challenge the constitutionality of a 2008 federal statute that expanded the authority of federal officials to conduct secret electronic surveillance of foreign citizens who are in other countries. http://abcnews.go.com/Politics/OTUS/supreme-court-hear-electronic-surveillance-case/story?id=17564982, as well as a case that considers whether the sniff of a police dog on the front porch of a person's home constitutes a search and requires a warrant.

Off the bench, all eyes will be on Chief Justice John Roberts when he administers the oath of office to President Obama. The Presidential Inaugural Committee announced last week that the president will be officially sworn in Jan. 20, which falls on a Sunday, and then again on Monday, Jan. 21, for a ceremonial swearing in.

Roberts slightly flubbed the oath in 2009 and had to re-administer it at the White House.

Justice Sonia Sotomayor will swear in Vice President Biden. She becomes the first Hispanic to administer an inaugural oath. In a statement, the vice president said that "one of the greatest pleasures of my career" was to be involved in Sotomayor's selection to the court.

"From the first time I met her, I was impressed by Justice Sotomayor's commitment to justice and opportunity for all Americans, and she continues to exemplify those values today," he said.

In the coming weeks, Sotomayor will also launch a book tour for her memoir, "My Beloved World." The Associated Press, which received an early copy, reported in December that the justice discusses her lifelong battle with diabetes, her upbringing in the South Bronx, as well as a defense of affirmative action.

The educational landscape in England is rapidly changing. Provision driven by outcomes is at the top of the government?s agenda for education. The focus on educational underachievement has never been so strong. An increase in the number of Academies, Free Schools, curriculum reform, workforce development, the introduction of the Pupil Premium and changes to the inspection process since January 2012 have all contributed to increased school accountability. Through the Ofsted Framework for Inspection (2012) head teachers are now accountable for accurately identifying and effectively addressing the needs of young learners at risk of underachievement (i.e. attainment and progress). Head teachers provide tangible evidence of their approach and success in narrowing the achievement gap for vulnerable groups-those eligible for Free School Meals (FSM), Looked After Children (LAC), children and young people with SEN (D) and others. In practice these groups intersect. Pupils with SEN are two times more likely to be eligible for FSM than their peers and at 31st March 2011, almost 73% of the 28,440 LAC had SEN compared to 21% of all pupils (DfE, 2012). These are challenging statistics.

For many children in England, opportunities for success are still fragmented. This is particularly true for children and young people from disadvantaged families and other vulnerable groups. In 2011, there was a 27% point gap in achievement of 5 or more A*- C GCSEs (standard benchmark) between those eligible for Free School Meals and their peers. This has barely narrowed in the last few years. In 2008, this figure stood at 28% points (Ofsted, 2012a). The Pupil Premium, introduced in April 2011, has gone some way in providing schools with money to improve outcomes for their disadvantaged pupils. Head teachers determine the most effective way to use the Pupil Premium, but are accountable through performance tables, the Ofsted Inspection Framework and online reports to parents (introduced in September); from this year teachers and schools which most effectively enhance the attainment of their disadvantaged pupils will be acknowledged through awards and teacher scholarships.

Achievement for All concentrates on these vulnerable groups- disadvantaged children, those with SEN (D) and other low attaining pupils. For these children, their educational horizons are blighted; lack of aspiration, access and achievement characterise their experience of school and beyond. At 19 years old, 36% of care leavers are not in education, employment or training (NEET) and? 24% of prisoners had been taken into care at some point in their childhood compared to 2% of the population (DfE, 2012a)

Achievement for All works in partnership with schools to support these groups of learners. The particular strategies developed through the framework have resulted in unprecedented improvement in children?s outcomes. This was particularly significant in reading, writing and maths. A focus on leadership, trends in pupil attainment and progress, goal setting, targeted outcomes, teacher development, parental engagement, behaviour, attendance and exclusions have shown that outcomes for the most disadvantaged groups can be significantly improved.

Pupil Premium

The introduction of the Pupil Premium has enabled schools to focus on improving the achievement of their most disadvantaged pupils. Introduced in addition to the main school budget, the pupil premium is directed towards pupils eligible for FSM, Looked After Children and more recently the children of those in the Armed Services. In January 2012, 18.2% of children were claiming FSM. Its wider aims include reducing the attainment gap, increasing social mobility and enabling disadvantaged pupils to get into top universities (Higgins et al, 2011). Funding through the pupil premium stood at ?1.25billion in 2012-2013 and will increase to ?1.875 billion in the coming year; schools will receive ?900 per pupil. However, a recent report by Ofsted (2012b) highlighted the inefficient use of Pupil Premium by many schools. A number did not disaggregate the additional money from their principal school budget and many failed to provide extra opportunities for pupils. The most common use of the Pupil Premium was to fund teaching assistants. Conversely, recent research from Sutton Trust shows that Pupil Premium spent on the development of effective teaching and learning strategies is beneficial to pupils. These include such areas as effective feedback and getting students to think about their learning (Higgins et al., 2012).

Language development and learning

Many of the most vulnerable groups enter school with varying degrees of language delay. There is a need to improve language and learning. In January 2011, Speech, Language and Communication Needs (SLCN) were the most common primary need amongst primary school children in England. 29% of all state funded primary school pupils at School Action Plus or with statements had this as their primary need (DfE, 2012). The association with poverty is clear; approximately 50% of the most disadvantaged children have lower levels of speech and language skills than their peers (Bercow, 2008).Pupils eligible for Free School Meals are 2.3 times more likely to have Speech, Language and Communication Needs than other children (Dockrell et al, 2012). Dockrell et al (2012; p8) highlight the need to move away from a applying a generic SLCN category to identified children . They call for a ?profile? of individual pupil strengths and weaknesses and highlight the need to focus on this in personalising their learning and education plan.

The importance of early intervention is clear. Many of those with language delay on entering school are at risk of remaining behind their peers throughout their education (Snowling et al, 2011 and Tickell, 2011). These children have difficulty with reading and writing, often present with poor behaviour and cannot socialise with their peers (Bercow, 2008; p14). However, through effective teaching and learning, focussed interventions and/or specialist support these children will make progress and attainment gaps will be narrowed.

The solution: effective support

Achievement for All has now been extended nationally to cover pupils eligible for Free School Meals and Looked After Children. Schools can fund the extra delivery through the Pupil Premium. Through a new partnership between Achievement for All 3As and ICAN, the children?s communication charity, the offer to schools will include programmes to improve pupils? language levels and boost attainment.

The Achievement for All framework is defined by elements common to all schools; evidence shows these areas have effectively improved outcomes for vulnerable groups. Schools develop a bespoke programme within the framework to build on their strengths and further develop specific areas. Through the Achievement for All /ICAN partnership schools can access specialist support and interventions to improve the outcomes for pupils with SLCN from the most disadvantaged groups.

Evidence from the Achievement for All pilot involving 28, 000 pupils in over 450 schools showed that pupils in pilot schools made greater progress in English and Maths than the national average (Humphrey and Squires, 2011). 37% made progress in English as great or greater than aspirational expectations for all pupils nationally; for maths, 42% of pupils made this level of progress.

After the first year of the national roll out, the impact of Achievement for All on pupil outcomes has continued to improve. Structured conversations with parents remain a clear success. Through focussed dialogue between staff and parents more personalised approaches to teaching and learning have developed; many schools are now beginning to develop evaluation tools to further develop structured conversation to their context. The bespoke nature of the programme has been a clear advantage to schools; many have reported how it has enabled them to address the very specific needs of staff, pupils and their parents. The particular collaborative approach of the programme has provided the opportunity for schools, notwithstanding leadership challenges, to embed the practices and processes of Achievement for All within the school and the I CAN ?Talk Boost? initiative, appropriately train staff and disseminate good practice to other schools. Data collection and tracking of pupil progress and attainment has been enhanced in Achievement for All schools; head teachers report on more effective analysis of data and better comparison between individuals and groups.? A focus on wider outcomes during the national roll- out has resulted in improved pupil behaviour, self- esteem and attendance. Evidence of the success of Achievement for All programme is reflected in the following comments made by schools (head teachers, teachers, and other staff) at the end of the first year of the national programme:

?Leadership of Achievement for All is ensuring a focus is maintained on the achievement, access and aspirations for pupils in vulnerable groups, including the provision of high quality teaching and learning?. (Primary School, Term 3)

?All parents have rated the structured conversation experience at 8, 9 or 10 on a 1-10 scale. Parents say they like the structure and order. They like having the chance to talk and also like the planning at the end. Staff feel more confident about talking to Hard-to-reach parents and because it is monitored teachers have gone the ?extra mile? to encourage parents in. The actions

include making phone calls, texts and arranging meeting to suit the parents. The structure helps everyone. Most conversations have lasted 30 minutes with successful outcomes.? (Primary School, Term 3)

?High quality teaching and learning has led to the progress made by pupils?Progress over the year was pleasing ? all areas have improved by 2APs reading intervention continues to work well.? (Special School, Term 3)

?Our Achievement Coach has proved to be extremely valuable for the teacher of the new Year 5 target group. She has engaged fully with the programme and I have been able to work closely with her through observations and consultation. The provision in her class for children with SEND is excellent and she has found that the Achievement for All support has been pivotal in enabling her understanding of SEND to grow and be reflected in the provision she delivers.? ?Whenever possible students are involved in structured conversations and this heightens their awareness that the school and home are working together to improve their achievements. The response of staff and parents/carers to the process of structured conversations has been very positive.?(Secondary School, Term 3)

The evidence provides examples of positive steps towards enabling all children to aspire, increase access and achieve in school and in the world beyond; policy makers and educators alike acknowledge the opportunity provided through a partnership between Achievement for All and I CAN, to a greater number of children across England, and the appropriate use of the Pupil Premium.

Citigroup CEO names new executive team

NEW YORK (Reuters) - The new chief executive of Citigroup Inc named two company veterans to lead its institutional and consumer businesses on Monday and set lines of command to give him more direct responsibility for executives than his predecessor.

CEO Mike Corbat said on Monday that investment banker Jamie Forese will be head of institutional business and co-president of the company with Manuel Medina-Mora, who will continue to oversee global consumer banking and Citi's franchise in Mexico.

Corbat decided not to fill the post of chief operating officer, which was held by John Havens, who left when Corbat was named on October 16 to replace Vikram Pandit as CEO.

In January 2011, Pandit had put Havens, a longtime ally from their days managing a hedge fund, in charge of day-to-day operations and assigned him responsibility for several managers so he could focus on broader goals.

The new organizational chart shows 13 managers under Corbat and includes chiefs of major business categories, executives who oversee four major regions and managers in companywide functions.

The goal of the structure is to "strike the right balance of authority and responsibility," Corbat said in a memo to employees, which was included with the announcement.

At the same time, Corbat has given Forese and Medina-Mora oversight of the operations and technology support staff for their individual business lines. Chief Administrative Officer Don Callahan's responsibilities have narrowed to companywide support.

Corbat, 52, can now begin to step out in public more after putting his executive team in place and spending nearly three months focusing on internal matters and relationships with regulators and Citigroup's biggest investors and clients.

The company was set by the end of Monday to submit a capital plan to Federal Reserve officials to test scenarios of economic stress.

On December 5, Corbat marked the completion of his budget for the new year by announcing a plan to eliminate 11,000 jobs, or about 4 percent of Citigroup's workforce.

Citigroup and other financial lenders are under added pressure to reduce costs because of less demand for loans, lower profits from lending and tighter regulations.

Forese and Medina-Mora, the two executives under Corbat with the most responsibility, were at the company long before Pandit became CEO in 2007. "Jamie and Manuel have both spent their entire careers at Citi and its predecessor companies," Corbat noted.

The new team includes Brian Leach, chief risk officer, who with Pandit was a founder of the Old Lane hedge fund that Citigroup bought in the mid-2000s. Leach will now hold the title of head of franchise risk and strategy and be responsible for audit, compliance, corporate policy and strategy, in addition to risk management.

Brad Hu, who has been head of risk for the Asia-Pacific region, will become chief risk officer and report to Leach.

Jim Cowles will become head of one of the company's four major business regions - Europe, the Middle East and Africa. Cowles has been chief operating officer for EMEA. He had also served as global head of equities.

Chief Financial Officer John Gerspach will also lead expense management, Corbat said.

Corbat also said these executives will have the following responsibilities: Bill Mills, CEO for North America; Francisco Aristeguieta, CEO of Latin America; Stephen Bird, CEO of Asia Pacific; Gene McQuade, CEO of Citibank NA, the primary bank subsidiary; Ed Skyler, head of public affairs; Paul McKinnon, head of human resources; Rohan Weerasinghe, general counsel and corporate secretary.

Lew Kaden, a vice chairman who recently was a member of the company's business development committee and a former chief administrative officer, plans to retire, Corbat said.

Citi shares dipped 0.6 percent to $42.16 in early afternoon trading.

Can blood pressure drugs reduce the risk of dementia?

Jan. 7, 2013 ? People taking the blood pressure drugs called beta blockers may be less likely to have changes in the brain that can be signs of Alzheimer's disease and other types of dementia, according to a study released today that will be presented at the American Academy of Neurology's 65th Annual Meeting in San Diego, March 16 to 23, 2013.

The study involved 774 elderly Japanese-American men who took part in the Honolulu-Asia Aging Study. Autopsies were performed on the men after their death. Of the 774 men, 610 had high blood pressure or were being treated with medication for high blood pressure. Among those who had been treated (about 350), 15 percent received only a beta blocker medication, 18 percent received a beta blocker plus one or more other medications, and the rest of the participants received other blood pressure drugs.

The study found that all types of blood pressure treatments were clearly better than no treatment. However, men who had received beta blockers as their only blood pressure medication had fewer abnormalities in their brains compared to those who had not been treated for their hypertension, or who had received other blood pressure medications. The brains of participants who had received beta blockers plus other medications showed an intermediate reduction in numbers of brain abnormalities.

These included two distinct types of brain lesion: those indicating Alzheimer's disease, and lesions called microinfarcts, usually attributed to tiny, multiple, unrecognized strokes. Study participants who had taken beta blockers alone or in combination with another blood pressure medication had significantly less shrinkage in their brains.

"With the number of people with Alzheimer's disease expected to grow significantly as our population ages, it is increasingly important to identify factors that could delay or prevent the disease," said study author Lon White, MD, of the Pacific Health Research and Education Institute in Honolulu. "These results are exciting, especially since beta blockers are a common treatment for high blood pressure."

Earlier research has shown that high blood pressure in midlife is a strong risk factor for dementia.

(AP) ? Russell Wilson raced ahead to throw the final block on Marshawn Lynch's fourth-quarter, go-ahead touchdown run, doing just enough to get in the way of the Washington Redskins safety near the goal line.

Less than a minute later, Robert Griffin III's knee buckled as he tried to field a bad shotgun snap, the pain so bad that he didn't even try to recover the ball.

The last rookie quarterback standing in the NFL playoffs is Wilson ? the third-round pick who teamed with Lynch on Sunday to lead the Seattle Seahawks to a 24-14 victory over Griffin and the Redskins.

"Marshawn always tells me, 'Russ, I got your back, no matter what,'" Wilson said. "So I just try to help him out every once in a while."

And the latest debate over the wisdom of keeping an injured franchise player on the field ? when he's obviously nowhere near his best ? starts with coach Mike Shanahan, who let Griffin keep going until the QB could absolutely go no more.

"I think I did put myself at more risk," Griffin said. "But every time you get on the field, you're putting yourself on the line."

Lynch ran for 132 yards, and Wilson completed 15 of 26 passes for 187 yards and ran eight times for 67 yards as Seahawks overcame a 14-0 first-quarter hole ? their biggest deficit of the season ? and will visit the top-seeded Atlanta Falcons next Sunday.

Meanwhile, Griffin was headed for an MRI exam to determine the extent of the damage on his re-injured right knee. He was already playing with a big black brace, having sprained the lateral collateral ligament about a month ago against the Baltimore Ravens. He hadn't looked his usual self in the two games he had played since, and he was obviously hobbled after falling awkwardly while throwing an incomplete pass in the first quarter Sunday.

In the fourth quarter, Griffin labored on a 9-yard run that made him look 32 years old instead of 22.

"He said, 'Hey, trust me. I want to be in there, and I deserve to be in there,'" Shanahan said. "I couldn't disagree with him."

Shanahan said he'll probably second-guess himself over his decision. He has the entire offseason to do so. And, whatever the injury, Griffin at least has time to recover.

Wilson, on the other hand, will carry on. The day began with three rookie quarterbacks in the playoffs, but No. 1 overall pick Andrew Luck was eliminated when Indianapolis lost to Baltimore.

Seattle is riding a six-game winning streak, having left behind any doubts that the team can hold its own outside the Pacific Northwest. The Seahawks were 3-5 on the road in the regular season and had lost eight straight road playoff games, the last win coming in 1983 against the Miami Dolphins.

"It was only two touchdowns, but it's still a big comeback and, in this setting and the crowd, it's a marvelous statement about the guys' resolve and what is going on," Seattle coach Pete Carroll said. "It's not about how you start but how you finish."

Seattle's defense shut down the Redskins after a rough start. Washington had 129 yards in the first quarter and 74 for the rest of the game. Griffin was 6 for 9 for 68 yards and two touchdowns after 15 minutes; he was 4 for 10 for 16 yards with one interception the rest of the way.

"It was hard to watch RG3 tonight," Carroll said. "It was hard on him. He was freaking gallant."

The numbers were reversed for the Seahawks, who rediscovered Lynch in the second quarter and put together three consecutive scoring drives to pull within a point, 14-13, at halftime.

Steven Hauschka, who injured his left calf during the first half and had to relinquish kickoff duties, nevertheless sandwiched field goals of 32 and 29 yards around a 4-yard touchdown pass from Wilson to Michael Robinson. Wilson fumbled on the TD drive, but the ball was fortuitously scooped up by Lynch, who ran for a 19-yard gain.

The Seahawks controlled the second half, but then it was Lynch's turn to fumble ? at Washington's 1-yard line. The Redskins recovered this one, and the Seahawks had another drive get to Washington's 28 before a sack forced a punt ? rather than a long field goal attempt by an injured kicker.

But the Seahawks kept coming. Wilson led the way for two big change-of-direction runs by Lynch in the game, the second one a 27-yard scoring run with 7:08 remaining.

A 2-point conversion gave the Seahawks a 21-14 lead, and then came the moment that essentially put the outcome to rest.

On the second play of the Redskins' next possession, Griffin's knee bent the wrong way on a second-and-22 at the Washington 12. He lay on the ground as the Seahawks pounced on the ball.

Griffin walked off the field under his own power, but he was done for the night. By the end of the game, he was sitting alone on the white sideline bench, his brace discarded on a bench next to him.

With good field position, the Seahawks kicked a short field goal to give them the insurance they needed. Fellow rookie Kirk Cousins, subbing for Griffin, was unable to rally the Redskins in the final minutes.

"Despite the fact that we have a 'nobody' team," Seattle cornerback Richard Sherman said, "a team not full of first-rounders and things like that, we have a lot of guys that play at a high level."

NOTES: DE Chris Clemons, Seattle's best pass rusher, hurt his left knee in the third quarter and did not return. He will undergo an MRI. "We're concerned about it," Carroll said. ... Redskins LG Kory Lichtensteiger re-injured his sprained left ankle in the first quarter. ... The playoff meeting between the two teams was the third, but first outside Seattle. The Seahawks won 20-10 in January 2006, and 35-14 in January 2008. Those were the last two postseason games played by the Redskins. ... Redskins LT Trent Williams shoved Sherman in the face as the teams met on the field after the final whistle. "It was a dirty move by Trent Williams," Sherman said. "I can understand why he's frustrated; it's the end of their season." Williams took responsibility and said he acted in an "immature manner." Later, Sherman tweeted that he received "a very classy text" message from Williams and there's "no ill will either way."
