U.S. military to arraign soldier accused of Afghan massacre

SEATTLE (Reuters) - A U.S. soldier accused of killing 16 villagers in Afghanistan is due to be arraigned on Thursday on charges of premeditated murder, for which military prosecutors are seeking the death penalty.

Robert Bales, a veteran of four combat tours in Iraq and Afghanistan, is accused of gunning down the villagers - mostly women and children - in their homes in two villages in Afghanistan's Kandahar province.

The shootings occurred over a five-hour period in March. It was one of the deadliest incidents the military has blamed on a rogue U.S. soldier since the Vietnam War and strained U.S.-Afghan relations.

Prosecutors say Bales, 39, acted alone and with "chilling premeditation" when, armed with a pistol, a rifle and a grenade launcher, he left his base twice, returning in the middle of his rampage to tell a fellow soldier: "I just shot up some people."

During a pre-trial hearing in November at Washington state's Joint Base Lewis-McChord, where Bales is being held and where Thursday's arraignment will take place, witnesses testified that he had been angered by a bomb blast near his outpost that severed a fellow soldier's leg days before the shootings.

The government believes Bales was solely responsible for the deaths, and survivors have testified that they saw only one U.S. soldier. However, several indirect accounts have suggested more than one soldier may have been involved.

Bales was bound over for court martial in December and faces 16 murder charges, as well as other charges, including attempted murder, assault and drug and alcohol charges.

"(The arraignment) makes it official, that he is about to go into a court martial. It also gives the defense and prosecution an opportunity to present motions," Army spokesman Gary Dangerfield said, adding that Bales would hear the summary of charges against him and be able to enter a plea.

Bales' lawyers declined requests for comment.

POSSIBLE POST-TRAUMATIC STRESS

Defense lawyers have not set out an alternate theory of the case, but have pointed out inconsistencies in pre-trial testimony and highlighted incidents before the shooting where Bales lost his temper easily.

Those incidents could possibly set up an argument that Bales was suffering from post-traumatic stress disorder.

"His defense attorneys would be wise to ask for further expert evaluation of his sanity," said Mary D. Fan, a former University of Washington law professor who is following the case. "They might be able to argue (that), at the time, Bales couldn't tell right from wrong."

Fan added that she expected Bales to enter a plea of not guilty or perhaps defer a plea pending further negotiation with prosecutors and an independent mental evaluation.

Army prosecutors told Reuters in November they would arrange for Afghan witnesses to testify in person during the court martial. Prosecutors have already presented physical evidence to link Bales to the crime scene, as well as blood-splattered camouflage clothing.

For Bales to be executed, a military jury must unanimously find him guilty of the eligible crime and at least one aggravating factor that largely outweighs any mitigating circumstances, the Army said.

Evidence of any mental illness, post-traumatic stress disorder, extended combat experience, and the presence of alcohol and other substances could be "critical evidence," said civilian defense attorney Colby Vokey, a retired Marine lieutenant-colonel.

The military justice system also requires the U.S. president to approve the execution of a service member, which last occurred in 1961.

"You can't receive the death penalty in the military with anything less than premeditation," said Victor Hansen, vice-president of the National Institute of Military Justice.

Analyzing the Windows 8 sales numbers: Chicken, meet egg

For the past few months -- really, since the day Windows 8 and Windows RT became commercially available in late October 2012 -- there have been lots of attempts to calculate how it's really selling.

Microsoft officials have said Windows 8 is selling at the same clip as Windows 7 did.

Microsoft's figures are measurements of Windows upgrades, which are sold at a discount to existing Windows users, plus licenses sold to OEMs. (OEMs don't buy Windows licenses on a "just-in-time" basis, I've heard. Instead, they attempt to predict what they'll sell and then order a set number of licenses at least a month ahead of time, according to one source of mine.)?Microsoft's latest claim of 60 million Windows 8 licenses sold might or might not include sales of Windows RT, too. (Company officials have declined to say.)

NPD tracks a different set of numbers -- copies of Windows sold preinstalled on PCs sold at retail. (NPD's numbers include neither Surface RT sales nor in-store Windows upgrade sales.) Neither Microsoft's nor NPD's estimates includes sales of Windows through volume license agreements, which is how users like the ?U.S. Department of Defense recently bought Windows (and Office) licenses, which will allow the agency to deploy Windows 8 and/or to downgrade to an older version of Windows.

In addition to the discrepancies around what's being counted, no one seems to agree which is the chicken and which is the egg in the Windows-sales equation. By that, I mean the set of circumstances which one Microsoft watcher considers to be the "cause" is seen by another as the "effect."

Example: Are Windows PCs failing to sell as well as in previous years because users are confused by and unhappy with Windows 8? Or is it that PC sales were already in free-fall and it's only the release of Windows 8 that's keeping them even marginally afloat?

Another: Was it the shortage of touch-enabled Windows 8 and Windows RT PCs and tabets that led to lower-than-expected retail sales this past holiday season? Or was it the higher price Windows OEMs are charging for touch-enabled PCs and tablets that have led to less-than-stellar sales?

My personal favorite: Microsoft officials say users have been actively seeking out touch-enabled Windows 8 PCs and tablets. But maybe they're just looking for new Windows tablets and PCs and soon (once existing non-touch-enabled PC inventories are depleted) will have no choice but to get touch-enabled ones.

And one more: Did Microsoft's decision to advance the date when it started encroaching on OEM territory by selling the Surface through retailers like Best Buy and Staples lead to some of these OEMs' lessening enthusiasm for Windows 8 and Windows RT? Or did Microsoft have no choice but to push the Surfaces through more retailers because of the dearth of Windows 8 and Windows RT tablets and PCs from OEMs in retail stores?

Outside of a chosen few inside Microsoft, no one really knows how many Surface RT devices Microsoft has sold, or how many copies of Windows 8 have been activated by consumers. There've been lots of guesse, educated and otherwise. I'd argue the muddling of causes and effects in all these estimates adds another layer of complexity to attempts to determine whether Windows 8 and Windows RT are "successes" or "failures."

I know I use the internet and can't live without it any more, I am still disgusted with the way the internet has basically took over everything and is making companies lose out on business and hundreds of jobs are being lost. It is happening as we speak, and it is very worrying.

I have now heard that HMV (UK record shop) is going under because of so many people shopping online for DVDs and CDs. That is my favourite shop, it is the only place I can go when I need to go to a shopping centre (to get some shoes that need trying on or something) and after I get what I wanted I usually go into HMV and have a look, to kill time before the next bus, because I can't hang around in clothes shops for too long, and that's all there is. Now HMV is gone I will have nowhere exciting to look. It's really not fair. So many stupid idiotic people are buying things online, but there are still millions of people that like to actively browse around the shops too, for something to do.

I am also worrying that all this internet shopping will soon destroy every retail business and there will be no shops left standing any more, instead everywhere will just get derelict. People don't realise that the internet is destroying everything. It is worrying me.
Not only that, the internet isn't that reliable. Computers cost to update, you have to be careful of viruses, you have to be careful of what you're buying, you have to be careful of what you're downloading, and it is easy for people (older people that aren't used to computers, or people who are stupider than average, like me,) to end up getting their bank accounts hacked into. I tried downloading Adblocker the other day from Google, and I suddenly ended up with SweetIM as my browser, and I couldn't get rid of it, and it slowed down all my internet and everything. Now after fiddling around I have finally removed it, but my internet is still having a few problems with speed ever since. Also the connection from the router randomly cuts out and disrupts everything. This can be more frustrating than going out shopping among crowds of people sometimes...

out of town malls are what screwed up UK high streets.

the web is most useful to me, good for finding tip top things that I need at the right price, books that are not mainstream to feed my brain and it has rejuvinated my own particular niche manufacturing business, ahhhhhh ... the joy

of not having to go to a town and deal with surly uncommunicative ass-hole sales ppl .....

I often wish I could order my weekly supply of groceries online instead of going to the store because I HATE the crowds, and the line-ups, especially around holidays and when people get their monthly checks. I didn't always hate grocery shopping but the store I go to recently got expanded and now it there seem to be more people than ever there and there aren't many other stores that have a decent stock of groceries nearby. When I'm shopping there it seems all I say is excuse me excuse me sorry, sorry for being in your way, SORRY FOR EXISTING!!! And I normally take my time while everyone else rushes around in complete madness. It's like I can't even take a minute to decide what to choose from all the products, prices, and quality and then I turn around and see I'm blocking someone who wants to get past. Are the aisles getting more narrow, or am I getting more wide? Laughing I also seem to have a weird curse there when I'm next in line the cashier suddenly seems to forget how to use the cash register or someone calls her and she puts ME on hold, or the person in front of me is an 80-year old and forgets how to use a credit card or cash a check. There are screaming kids and teens yapping away on phones and since I don't have a car or drive I have to call my mother on the phone to drive me back to my apartment. But the store people don't like people having their cars right in front of the doors so I have to lug my shopping cart down to this empty corner on the sidewalk while I wait and it could be freezing or frying but there's not place to go inside. And one time some guy came up to me asking for a smoke. Not a teen but a grown man! I don't smoke and wasn't smoking, so why would he assume I had cigarettes on me, that is so stupid and annoying! Also I have to try to be home before the kids in the high school across the street are let out for the day or there will be cars and buses everywhere and sometimes my mom can't even drive up to the steps to my apartment. So I have to lug my bags of groceries such as big bags of kitty litter even further and then up two sets of stairs. UGH!!! wall Of course I don't want all stores to close down because where I live there's not much else to do or to go to. There's not a lot outside my home I feel like doing, anyway. But most of the other stores in the "city" I live in are terrible. I'm lucky if they have something that I really want and end up searching all over for it and they don't have it if I ask if they will get it soon the answer is nearly always I don't know. When I was a kid going to town or the mall was like going to Disneyland, but back then the stores were a lot better and everything was more fun as a kid but not any more. Sad and I can't order stuff online even when I want to because I have no credit cards I can't afford them and I don't get this Pay Pal thing or whatever it's called. Sad I know this was a very long rant, but I just had to get it out even though I just let my Mr. Noodles boil into a pot of disgusting sludge on the stove. Good thing I didn't set the place on fire. Embarassed

Well, it's happening because it's far more convenient to use the Internet and it's often much cheaper.

Would I rather get a DVD online for ?8-?9 and get it delivered right to my door, or would I rather go to Preston and spend ?15-?20 from a brick and mortar store? No contest, really.

No, it's not. I think it's a good thing if new, successful companies take their place (I can't see this happening at this moment in time). It's also the last major offline music/DVD chain. To be honest with you, I'm amazed it's been allowed to be kept going for as long as it has. I would have expected it to have gone under by around 2008 or 2009.

Have you downloaded something like CCleaner or HijackThis to get rid of all the remaining crap?

a, Most people that I know are upset that HMV is going

b, Shops aren't just for walking in and buying something and walking out again, lots and lots of people like to browse, and because I love films, I usually end up buying loads of DVDs in HMV just because of browsing

c, I have everything on my computer (ccleaner, anti-virus software installed and updated, and other stuff like that), but my internet is still slow because when I type something on the internet there is a lag so some letters don't get typed which is annoying (so I've got to type every post on a word document then copy and paste it), and I didn't used to have to do that before I accidentally installed that shitty SweetIM crap. I don't even know where this SweetIM came from, it said ''install Adblocker now'' on the button that I pressed

d, As if everyone who doesn't use a computer has got time for computer lessons

e, you DO have to be careful with what you buy online, because hackers can get in so easily, and there are a lot of scams, etc

f, There is a lot of sarcasm in this thread, Mods, please get rid of the thread now, I made a huge mistake and didn't know WP users would be so against it

A man who found six children in his driveway in Newtown, Conn., after their teacher had been shot and killed in last month's school massacre has become the target of conspiracy theorists who believe the shootings were staged.

?I don?t know what to do,? Gene Rosen told Salon.com. ?I?m getting hang-up calls, I?m getting some calls, I?m getting emails with, not direct threats, but accusations that I?m lying, that I?m a crisis actor, ?How much am I being paid?'?

Rosen, a 69-year-old retired psychologist who lives near Sandy Hook Elementary School where the shootings took place, says his inbox is filled with emails like this one:

How are all those little students doing? You know, the ones that showed up at your house after the ?shooting?. What is the going rate for getting involved in a gov?t sponsored hoax anyway?

?The quantity of the material is overwhelming,? Rosen said, adding that he's sought the advice of a retired state police officer and plans to alert the FBI.

On the morning of Dec. 14, Rosen had just finished feeding his cats when he saw six small children "sitting in a neat semicircle" at the end of his driveway. According to the Associated Press:

A school bus driver was standing over them, telling them things would be all right. It was about 9:30 a.m., and the children, he discovered, had just run from the school to escape a gunman.

"We can't go back to school," one little boy told Rosen. "Our teacher is dead."

Adam Lanza, the 20-year-old gunman, had shot his way into the school and opened fire, killing 20 children and six adults.

Rosen took the four girls and two boys?students of slain teacher Victoria Soto?into his home, gave them toys and comforted them while he tried to reach their parents. He spent the days following the massacre telling his story to the swarming media that invaded the small Connecticut town in the wake of the shootings.

?I wanted to speak about the bravery of the children,? Rosen told Salon. ?I guess I kind of opened myself up to this.?

A quick Web search for Rosen's name reveals some of what he's opened himself up to: Appearing online are photos of his home, his address and phone number, several fake YouTube accounts and plenty of conspiracy theories.

One post, entitled "Grieving Town Grandfather, or Bad 'Crisis Actor,'" reads in part:

Gene's oft repeated, and changing, story about that day, focuses totally on the kids and the sound of gunshots. Even though his eyes and ears should've taken in the whole scene, his story focuses completely on the kids and the guns.

Why? Well, if this was a false flag event designed to move political opinion on gun control, here in America, then you would get a lot more bang for your buck by talking about the innocent little children. That's what tugs on America's heart strings the most ... especially around Christmas time.
