Microsoft sues Motorola in Germany again, claims Google Maps violates patent (update: Google involved)

Microsoft and Motorola

Motorola isn't going to escape as cleanly as it would like from Microsoft's patent lawsuit campaign. Microsoft has sued Motorola once more in Germany, only this time it's waging a more direct fight against Motorola's owner Google. The lawsuit claims that Motorola devices violate a patent for taking map information from one set and overlaying it with data from another -- a technique that describes Google Maps, not to mention virtually every internet-connected mapping system we know. Details aren't yet available for the devices allegedly at risk, but the accusation would make it harder for Google, Motorola or both to simply code around the problem if they lose. No doubt Microsoft is counting on just that obstacle to have the RAZR maker fall in line with everyone else and take a license just for using Android.

Update: As patent case analyst Florian Mueller notes from his first-hand account, Microsoft quietly filed the lawsuit in April and received its first court hearing today. That's not the biggest news, however: Microsoft amended the lawsuit to include Google itself. While that's virtually necessary under German law to get the testimony Microsoft wants, it also means a rare (if not unique) instance of Microsoft attacking Google directly in court, rather than fighting proxy battles through Android hardware partners.

Bauer Gets Why Tourist Love Tra Vigne, MORE - Week in Reviews ...

travigne001.jpgTra Vigne. [Photo: Flickr]
Michael Bauer pays a visit to Tra Vigne, "the quintessential Wine Country restaurant," and he gets why tourists like the place. Although some of the food is over-salted, Bauer's impressed they take advantage of "at least four kinds of tomatoes" in the caprese salad and most of the desserts are very good. The restaurant's major downfall is pushy servers who seem to prey on the tourist diners: "when servers see a new face, instead of reading the table, they devour it like fresh meat." Still, a great atmosphere and memorable dishes earn Tra Vigne 2 ? stars, overall. [Chron]

After receiving her copy of Vietnamese Home Cooking, SF Weekly's Anna Roth samples Charles Phan's casual dining joint Out the Door in Lower Pac Heights. Though she writes that prices "would only be 'casual' to a 1 percenter," the dishes delivered, including the best ban xeo she's every had, explain why Phan has "so many accolades." The kitchen generally "treats the meat with respect," save for the "disappointingly dry" lemongrass pork chop. Even so, Roth feels lucky she can come to Out The Door when she wants Phan's food without cooking it for herself. [SF Weekly]

Responding to the hype of the Hayes Valley Italian restaurant Rich Table, SFBG's Virginia Miller decides to weigh in on the "ever-changing menu." The pastas seem to be her favorites, especially the duck lasagna: "a glorious pasta dish with no equal in this town... or in any other." Other strong points include a cocktail menu, specifically the Big Night, "which looks like a healthy, green veggie drink, but is subtly smoky Del Maguey Vida mescal." With "well-rounded and satisfying" dishes, and warm and engaging staff, she concludes: "Rich Table is primed for greatness." [SFBG]

San Francisco magazine's Sara Deseran savors the delicious open-faced sandwich, known as sm?rrebr?d at the Mission's Bar Tartine. She commends the sandwich shop for its range of topping including, "everything from house-cured salmon to chopped broccoli with onion jam and chili." But she notes there are other items on the menu "worth worshipping," namely the smoked and fried potatoes served "in a bowl with a dollop of pickled ramp mayonnaise." She adds: "They're unforgettable." [San Fran Mag]

THE ELSEWHERE: EBX hits Oakland's "Kimchi Row" eating at Oriental BBQ Chicken Town, Kang Tong Degi, and Dan Sung Sa; The Merc finds elevated bar food at District in Oakland; Marin IJ pairs brews with dishes at Mill Valley Beerworks; and finally, Chron gives 31st Union in San Matteo 2 ? stars.

Prostate cancer: Curcumin curbs metastases, study shows

ScienceDaily (Oct. 12, 2012) ? Powdered turmeric has been used for centuries to treat osteoarthritis and other illnesses. Its active ingredient, curcumin, inhibits inflammatory reactions. A new study led by a research team at Ludwig-Maximilians-Universit?t (LMU) in Munich now shows that it can also inhibit formation of metastases.

Prostate cancer is one of the most prevalent malignancies in the Western world, and is often diagnosed only after metastatic tumors have formed in other organs. In three percent of cases, these metastases are lethal. A research team led by PD Dr. Beatrice Bachmeier at LMU Munich has been studying the mode of action of a natural product that inhibits the formation of metastases. The compound is found in turmeric, a plant that has been used for medicinal purposes for thousands of years, and is a major ingredient of curry.

Bachmeier's research centers on curcumin, the polyphenol responsible for the characteristic color of curry. Curcumin is well tolerated and is therefore, in principle, suitable both for prophylactic use (primary prevention) and also for the suppression of metastases in cases where an established tumor is already present (secondary prevention). In a previous study Bachmeier and her colleagues had demonstrated that the substance reduces statistically significantly the formation of lung metastases in an animal model of advanced breast cancer.

Mitigating metastasis The new study was designed to investigate the efficacy of curcumin in the prevention of prostate cancer metastases, and to determine the agent's mechanism of action. The researchers first examined the molecular processes that are abnormally regulated in prostate carcinoma cells. Breast and prostate cancers are often associated with latent or chronic inflammatory reactions, and in both cases, the tumor cells were found to produce pro-inflammatory immunomodulators including the cytokines CXCL1 und CXCL2.

The researchers went on to show that curcumin specifically decreases the expression of these two proteins, and in a mouse model, this effect correlated with a decline in the incidence of metastases. "Due to the action of curcumin, the tumor cells synthesize smaller amounts of cytokines that promote metastasis," says Bachmeier. "As a consequence, the frequency of metastasis formation in the lungs is significantly reduced, in animals with breast cancer, as we showed previously, or carcinoma of the prostate, as demonstrated in our new study."

Curcumin and chemoprevention Bachmeier therefore believes that curcumin may be useful in the prevention of breast and prostate cancers -- which are both linked to inflammation -- and in reducing their metastatic potential. "This does not mean that the compound should be seen as a replacement for conventional therapies. However, it could play a positive role in primary prevention -- before a full-blown tumor arises -- or help to avert formation of metastases. In this context the fact that the substance is well tolerated is very important, because one can safely recommend it to individuals who have an increased tumor risk."

A daily intake of up to 8g of curcumin is regarded as safe, and its anti-inflammatory properties have long been exploited in traditional oriental medicine. Men with benign hyperplasia of the prostate (BHP) are one possible target group for prophylaxis, as are women who have a family history of breast cancer. The agent might also be valuable as a supplement to certain cancer therapies. At all events, curcumin's beneficial effects must first be confirmed in controlled clinical tests. Bachmeier is now planning such a trial in patients who suffer from therapy-resistant carcinoma of the prostate.

How To Give Constructive Criticism - Business Insider

Instantaneous technology has changed the way we communicate in the workplace.

Instead of yearly reviews, employees now want feedback and they want it often ? especially the younger workers.

"Communication is a big piece to what Gen Y-ers are looking for when it comes to relationships with their managers,"?Dan Schawbel, career expert and founder of?Millennial Branding, a Gen Y research and management consulting firm, told us.

Workers need to be able to discuss things with their bosses ? even if it's negative,?said?Nate Bagley, the director of communications at?The Bold Academy, but the problem is, not?everyone knows how to give ? or accept ? feedback if it's negative.

And this is a huge waste of time because ineffective communication solves nothing.?

Bagley said that most of the time, senior leaders ask for feedback, but only if it's something that already resonates with them. However,?in order to be an effective leader, Bagley said you need to have a "boss' mentality," meaning you need to learn how to give and accept constructive criticism.

"You need to learn how to separate your emotional feelings from your professional responsibilities."

Bagley shared with us his method for giving?constructive criticism:

1. Tell them how they're doing well.

2. Tell them what they need to improve.

3. End the conversation by telling them how they're doing well again.?

And to accept criticism, ask for examples.

Bagley said that if?an employee?has complained that you're micromanaging them, respond by asking them to take a day or two to come up with specific examples of you micromanaging and ask what actions they want you to take instead of the action that did occur.?

"Often we look at 'manager' as being a title, but it's also a whole new skillset," Bagley said. "You need to learn how to manage people with different personalities."

"When you understand how people work and how they want you to communicate with them, then you can be a better manager.?If you're having issues with your employees,?ask them what they don't like about their jobs and don't be offended when it's not what you want to hear."

PFT: Slauson fined 10K for block on Cushing

Aaron RodgersAP

Things aren?t going well this year for the Packers, and it?s creating frustration.? Which is leading to guys saying things that maybe they shouldn?t be saying.

The latest guy to let his frustration become verbalized is tight end Jermichael Finley.? Amid yet another disappointing season for the player who has plenty of potential, Finley blames his lack of production on an absence of chemistry with the team?s quarterback.

?It?s OK,? Finley said earlier this week, via Paul Imig of FOXSportsWisconsin.com.? ?Not good enough at all.? Something to be worked on, and try to work on it as much as I can, try to talk to him as much as I can, but like I said, it takes two people. . . .? I need the quarterback on my side, and I need to catch the ball when he throws it to me. So it takes two things to get that going, the chemistry. I feel we need to get that going.?

Imig notes that Finley used the ?C? word during the offseason.? ?I?m not blaming it on my offseason, but me and the QB didn?t have chemistry,? Finley said in June, after a minicamp practice. ?The routes were off sometimes, and that?ll mess with your head when the ball comes. . . .? I couldn?t get the chemistry with the QB.?

Imig also points out that, in August, Finley suggested that his numbers are a direct result of not being thrown the ball enough.? ?With my ability and what I think I can do, I?d say top two, that?s my goal,? Finley said. ?Those guys [Rob Gronkowski and Jimmy Graham] did have that one hit this year when they were rolling and hot, and they had the chemistry going and their quarterback?s trust. . . . [Tom Brady and Drew Brees] threw them the ball 20 times a game. You get the ball 20 times and you catch 10 of them, you should be doing something.?

(Jermichael, if you get the ball 20 times and you catch only 10 of them, your butt will be on the bench, with someone who can catch more than half the passes thrown his way playing instead.)

In an apparent effort to build that chemistry with Rodgers, Finley clumsily threw a bouquet to Rogers on Wednesday, after Rodgers admitted he isn?t playing as well as last year.? ?I would say, first of all, that?s a leader taking the blame on himself,? Finley said. ?That?s what you?re supposed to do as a player, like I would say it?s on me.? So you?ve got to check yourself.? I think that?s leadership.?

And that?s where Finley should have stopped.

?I think he?s playing good, but like I said, this is a team sport, and it?s going to take all 11 of us on the field when he?s on the field with us.? I don?t put it all on him.? It?s his receiving corps, we?re dropping balls; it?s his linemen not blocking for him.? He?s got a lot to think about.? I would be scared, too, if I was getting hit like that.?

So, yeah, Finley ultimately said Rodgers isn?t playing as well in part because Rodgers is scared.

And Finley wonders why he doesn?t have chemistry with Rodgers.

Stopping the itch: New clues into how to treat eczema

ScienceDaily (Oct. 11, 2012) ? More than 15% of children suffer with eczema, or atopic dermatitis, an inflammatory skin disease that in some cases can be debilitating and disfiguring. Researchers reporting in the October issue of Immunity have discovered a potential new target for the condition, demonstrating that by blocking it, they can lessen the disease in mice.

In eczema, immune T cells invade the skin and secrete factors that drive an allergic response, making the skin itch. Dr. Raif Geha, of Boston Children's Hospital, and his collaborators now show that scratching the skin precipitates the condition by encouraging an influx of other immune cells called neutrophils. These neutrophils secrete a lipid called leukotriene B4 that calls in more neutrophils, and more importantly, potent immune T cells that are the hallmark of eczema. These cells cause inflammation that aggravates the skin further. The investigators suspected that blocking the onslaught of these cells might slow down the disease or even stop it in its tracks.

Furthermore, Dr. Geha and his colleagues wondered whether the production of leukotriene B4 served to recruit T cells to the site of mechanical insult. And indeed that was the case. "We showed that a drug that blocks the production of leukotriene B4 blocks the development of allergic skin inflammation in a mouse model of eczema," says Dr. Geha. His team also found that deleting the receptors on immune cells that bind to leukotriene B4 had a similar effect.

"Our findings suggest that neutrophils play a key role in allergic skin inflammation and that blockade of leukotriene B4 and its receptor might provide a new therapy for eczema," says first author Dr. Michiko Oyoshi.

Most people get eczema as infants, and they tend to outgrow it by adolescence; however some people continue to experience "flare-ups" of an itchy rash on and off throughout life. Some develop these after coming into contact with particular substances, such as specific soaps, or in response to certain conditions, such as a respiratory infection or cold.
