WASHINGTON (AP) ? Unemployment rates fell or held steady last month in nine key swing states at the center of this year's presidential election.

Rates dropped in Ohio, Florida, Wisconsin, Colorado, Iowa, Nevada and North Carolina. They were unchanged in New Hampshire and Virginia.

The declines could help President Barack Obama at a critical time. With just 18 days until Election Day, polls show GOP challenger Mitt Romney gaining momentum with voters.

Overall, the Labor Department says rates fell in 41 states last month, rose in six and were unchanged in three. The national unemployment rate dropped in September to 7.8 percent, the lowest level since Obama's first month in office.

Still, many key states are facing high unemployment. The rate was 11.8 percent in Nevada and 9.6 percent in North Carolina.

In an attempt to bring a greater level of decorum to a city not known for order, Rome city council has passed a decree banning tourists from snacking in the historic center, which recognized by UNESCO as a World Heritage site.

That includes Piazza Navona, with its exquisite marble fountains, and the Pantheon, a vast Roman temple converted into a church. Other areas subject to the crackdown include Via dei Fori Imperiali, the broad avenue which links Piazza Venezia, Rome?s main square, with the Colosseum, the ancient arena where gladiators and slaves once fought.

"It is forbidden to encamp or erect makeshift shelters and stop to eat or drink in zones which have a particular historic or architectural value," reads the ordinance adopted by Rome city council this week.

The law is intended to ?guarantee the protection of areas of merit in the historic center,? it added.

In what one Italian newspaper, La Repubblica, called the start of a ?war on the panino," fines will range from 25 euros ($32) up to 500 euros ($650).

In many ways the new clamp-down reflects a schism in attitudes towards public eating between Italians and tourists.

Visitors may be happy to chow down on a slice of pizza or sandwich?on the steps of a Renaissance church or ancient Roman monument, taking a rest from the exhausting challenge of touring the city on foot. But that leaves most Romans aghast ? they rarely eat or drink on the street.

You don't see people guzzling enormous take-out coffees from paper cups; Italians go to a cafe for a cappuccino or a cafe macchiato, and drink it there, often standing up at the bar.

Eating in public is not done. I have even been told off for eating in a restaurant while reading a newspaper ? on the grounds that it will ruin my digestion, and that I should forget about work at least for an hour.

Rome is just the latest Italian city to try to curb indecorous behavior by tourists.

Similar bans have been adopted in Venice, where snacking is prohibited in St. Mark's Square and around famous landmarks, as well as Florence and Bologna.

But critics said the draconian new law could drive away tourists just as Italy needs them more than ever ? locals are spending less in restaurants, bars, and cafes as a result of a grinding recession and the imposition of austerity measures intended to tame the country?s 1.9 trillion euro national debt.

The center-right mayor of Rome, Gianni Alemanno, is acting like a ?sheriff? and ?transforming Rome into a city of rules and regulations,? said Angelo Bonelli, an opposition councilor in the city administration.

Others said Rome had more serious problems to contend with ? streets are often strewn with rubbish, illegal hawkers and touts harass tourists outside St. Peter?s Basilica and the Colosseum, and cars are allowed to double- or even triple-park.

?To start pestering tourists while they are eating lunch out of a bag really seems the last of our problems,? says Dario Nanni, a member of the left-leaning Democratic Party.

Italy has a somewhat checkered history when it comes to law enforcement, so whether tourists munching on sandwiches and slices of pizza really will be slapped with heavy fines remains to be seen.

Judge questions WTC blame of United Airlines in September 11 case

NEW YORK (Reuters) - A judge on Thursday questioned whether United Airlines could be held responsible for suspected airport security lapses that allowed hijackers onto the American Airlines plane that slammed into the World Trade Center on September 11, 2001.

Thursday's hearing before District Judge Alvin Hellerstein in Manhattan stems from one of the few remaining lawsuits arising from the hijacked plane attacks, which killed more than 3,000 people in New York, the Pentagon outside Washington, and Pennsylvania.

While most of the cases have settled, Larry Silverstein, the leaseholder of the World Trade Center property, is pursuing negligence claims against United Airlines, now United Continental Holdings Inc, and American Airlines. Silverstein says they should both be held liable for loss of property and business.

Silverstein's World Trade Center Properties is seeking additional damages beyond what he has already received from his own insurer. The hearing on Thursday dealt only with claims over the destruction of 7 World Trade Center, a building just north of the World Trade Center site that also collapsed in the attacks.

Silverstein argues that United is responsible for suspected security failures that resulted in the hijacking of American Airlines Flight 11, which slammed into one of the towers.

Those failures, the court heard on Thursday, began very early in the morning of September 11, 2011, when hijackers Mohammed Atta and Abdul Aziz al Omari set out on their trip.

That morning, Atta and al Omari boarded a US Airways flight from Maine's Portland International Jetport to Boston. From Logan International Airport, they connected onto Flight 11, which they commandeered and crashed into the World Trade Center.

Silverstein argues that because United was one of the carriers that operated Portland's only security checkpoint, it is responsible for the screening of all passengers that passed through it, regardless of what flight they are ticketed for.

United "had to be really vigilant when it did the screening," World Trade Center Properties attorney Richard Williamson told the court. "The first line of defense was Portland.... They were just asleep at the switch."

But Hellerstein appeared skeptical.

"Would I be acting inconsistently if I did not dismiss United?" the judge asked, referring to a 2009 order in which he dismissed claims against other airlines for damages caused by United Flight 175, which also crashed into the World Trade Center.

United urged Hellerstein to follow his own logic.

"The duty is to the passengers on our flights," United attorney Jeffrey Ellis told the court.

Hellerstein said he would reserve decision on whether to grant United's bid to dismiss the damage claims over 7 World Trade Center and the American flight.

Judges often do not rule immediately from the bench, preferring to study the issues especially if they are complex.

Silverstein's 2008 lawsuit also named aircraft manufacturer Boeing Co, the Massachusetts Port Authority, which manages Logan International Airport, and security companies as defendants.

He is seeking $8.4 billion in damages for loss of property and lost business, even though Hellerstein has limited the amount to the $2.8 billion Silverstein paid for the leases.

In August, Hellerstein denied the airlines' motion for judgment on whether $4 billion that Silverstein recovered from his insurers more than compensated for the potential damages recovery of $2.8 billion against the airlines, saying it was an issue for a jury to decide at trial.

The attacks prompted the creation of the U.S. Transportation Security Administration, which now oversees security at airport checkpoints.

Hellerstein, who sits in a courthouse less than a mile from the World Trade Center site, has presided over almost all September 11 litigation. Many of those lawsuits, including cases brought by relatives of those killed, people left injured, first responders, cleanup workers and businesses, have been settled.

The case is World Trade Center Properties LLC. et al v. American Airlines, Inc. et al, U.S. District Court for the Southern District of New York, No. 08-cv-03722.

Major environmental groups oppose damaging federal omnibus Bill ...

Omnibus bill again hides big changes to environmental laws, subverting democracy, weakening protection of air, water, soil and ecosystems

Vancouver, BC ? Once again, the federal government is proposing to make significant changes to environmental legislation without proper democratic debate, according to many of Canada's leading environmental organizations.

Instead, these changes are contained in a sweeping omnibus budget bill.

Canadians concerned about protecting the air, water, soil and natural ecosystems that support all of us ? and our economy ? are doubly troubled, both by the end-run around democratic process and the potential for even more pollution and destruction of critical habitat.

The bill includes proposed changes to laws protecting fish and navigable waters, preventing harm from hazardous waste and governing the shipping industry.

We will be reviewing these changes in more detail in the coming days to determine what impact they could have on environmental protection.

We note many of these pieces of legislation were also changed by the omnibus bill in the spring. Changing the same bill twice in one year underlines the value of debating specific bills, through appropriate committees ?the jobs our MPs are elected to do.

There is no need to subvert our legislative process in this manner, which only serves to heighten fears that already-weakened laws will get weaker still.

Kids and gunsThe American Academy of Pediatrics (AAP) is renewing its call to reduce the destructive effects of guns in the lives of children and adolescents, including counseling parents about safe gun storage as well as supporting legislation to prevent firearm injuries and deaths.

According to the AAP, the safest home for children and teens is one without guns. If there are guns in the home, scientific evidence shows the risk of injury or death is greatly reduced when they are stored unloaded and locked, with the ammunition locked in a separate place. Pediatricians routinely offer this injury-prevention counseling as part of their guidance to families at health care visits.

?Firearm injuries are often fatal ? there are few second chances,? said Marion Burton, MD, FAAP, immediate past president of the AAP. ?Young children are curious, and are often unable to remember or follow safety rules. Older children and teens naturally tend to be moody and impulsive. When you combine these traits with access to guns, the consequences can be tragic and permanent.?

The policy statement, ?Firearm-Related Injuries Affecting the Pediatric Population,? will be published online in Pediatrics Thursday, Oct. 18 in advance of the AAP National Conference and Exhibition Oct. 20-23 in New Orleans. The policy will appear in the November 2012 print issue of Pediatrics. The statement updates a previous policy statement published in 2000.

While the rate of firearm-related deaths has declined over the past two decades, it is still one of the top three causes of death in American youth, far exceeding the rates in other high-income countries. An estimated 38 percent of American households own guns; in gun-owning households with children under age 18, many of those guns are stored loaded and/or unlocked. The presence of guns in the home increases the risk of death from suicide or homicide.

Strong scientific evidence suggests that the presence of a gun in the home of an adolescent increases the risk of suicide, even in the absence of a psychiatric diagnosis, said pediatrician Denise Dowd, MD, FAAP, one of the lead authors of the statement.

?Adolescents often experience very strong emotions and have difficulty seeing past a temporary setback,? Dr. Dowd said. ?Their brains have not matured fully, which makes them impulsive, and relatively more likely to attempt suicide. When those attempts are made with a gun, there is little chance for them to change their minds. The odds of suicide are particularly high if the gun is kept loaded. It is absolutely critical that families who own guns follow safe-storage practices.?

Firearm-related injuries and deaths can be prevented when guns are stored safely away from children and adolescents in a locked case. Because of the severe, permanent nature of gun injuries in children, the AAP supports the strongest-possible legislative and regulatory approaches to reduce the accessibility of guns to children and adolescents:

  • Consumer product regulations regarding child access, safety and design of guns.
  • Child access prevention laws that enforce safe storage practices including the use of trigger locks, lock boxes, and gun safes.
  • Regulation of the purchase of guns, including mandatory waiting periods, closure of the gun show loophole, mental health restrictions for gun purchases, and background checks.
  • Restoration of the ban on the sale of assault weapons to the general public

Depression, shortened telomeres increase mortality in bladder cancer patients

ScienceDaily (Oct. 18, 2012) ? Low depressive symptoms and a longer telomere length are compelling factors that contribute to a prolonged life for bladder cancer patients, according to researchers at The University of Texas MD Anderson Cancer Center.

In an observational study, a team of MD Anderson researchers analyzed clinical and behavioral data collected from 464 bladder cancer patients, according to research presented at the 11th Annual AACR International Conference on Frontiers in Cancer Prevention Research.

"This is the first study of its kind that analyzes bladder cancer outcomes," said Meng Chen, Ph.D., an instructor in MD Anderson's Department of Epidemiology. "Psychological factors are not usually included in epidemiologic studies"

The patients observed were enrolled in an ongoing study of bladder cancer that provides extensive genetic, epidemiologic and psychological data. The collaboration of MD Anderson epidemiologists and psychologists is led by the study's principal investigator, Xifeng Wu, M.D., Ph.D., professor and chair of the epidemiology department.

Patients' information was analyzed according to four different groups. The first group involved patients with long telomeres and no depressive symptoms; the second identified patients who had long telomeres with depressive symptoms; the third had shortened telomeres and no depressive symptoms, while the fourth group had shortened telomeres and depressive symptoms.

Bladder cancer is the fourth most common cancer of men and is usually diagnosed in people over the age of 60. The American Cancer Society estimates 56,000 men and 18,000 women will have a bladder cancer diagnosis in 2012.

Research has identified shortened telomere length as an aging-associated biomarker in several diseases, including cancer. As people grow older, telomeres on the tips of chromosomes, which protect chromosomes from unraveling as cells replicate, shorten and eventually fail, leading to cell death. MD Anderson researchers analyzed blood samples to measure telomere length.

Depressive symptoms were analyzed using the Center for Epidemiologic Studies Depression Scale (CES-D). The self-report scale -- one of the most common screening tests used for finding levels of depression -- revealed patients who scored at high levels of depressive symptoms have a 1.89-fold risk of dying compared to those with lower levels of depression, who will live a little over three times longer -- 200 months vs. 58 months.

The study also revealed the combination of factors, longer telomeres and low levels of depressive symptoms, increased survival for bladder cancer patients by more than six-fold -- 31.3 months vs 199.8 months. Those with short telomeres and high levels of depression had a three-fold risk of mortality.

A certain level of stress, which has also been associated with shortened telomere length, is a dominating factor with many cancer patients. "People are not treating the depression directly, but mainly focused on coping with cancer,"said Chen. "This leads to additional stress that increases mortality."

Enhanced stress management should be an integral part of cancer treatment, "Lifestyle behaviors including a healthy diet, regular exercise and smoking-cessation are factors for reducing stress and ultimately depression in cancer patients." " said co-author Jie Lin, Ph.D., assistant professor in the Department of Epidemiology.

Lin also said the new risk factors such as psychological risk factors identified by the team could be included in future risk prediction models. The team is optimistic that this study will encourage clinicians to incorporate behavioral factors into risk models so interventions can be developed to prolong survival for bladder cancer patients.

Contributing authors to the work include Jan Blalock, Ph.D., Paul Cinciripini, Ph.D. from the Department of Behavioral Science, and Lorenzo Cohen, Ph.D., from the Department of General Oncology.
