Q: We recently signed a buyers agreement with a Realtor during the process of making an offer on a house. The offer was contingent on our current home selling. With this in mind, the realtor but a date in both the addendum and the buyers agreement for 6 months from now to give us time to sell our current home. The day after we put the offer in, the seller received another offer with no contingencies and they accepted this offer. At that point we started talking with a builder to build a new house in the same area. The Realtor that we signed the original offer with is saying that she has the right to represent us and get a commission on the new construction contract because the buyers agreement and addendum has a end date of 6 months from now. Is this true? We assumed that since the original buyers agreement had an addendum attached to it and that the addendum was now void since the house was sold to another buyer, that the buyers agreement would also be void. I guess the question is: If a buyers agreement had an addendum attached to it and that deal falls through, does the buyers agreement still stand or does the addendum take over?

A: Hi Buyer in Richmond:

Having a Realtor to represent you is always the smart thing to do. Even if you are talking to a builder, why wouldn?t you want your Realtor to represent you? It doesn?t cost you anything. Every deal is priced to include the buyers representation. There is no benefit to you whatsoever to purchase a home without a Realtor. I wish Legal representation was prepaid by the other party.

I do not understand why everybody think they should self manage real estate transactions. This is the only business where you get free service: Use it. This is the BIGGEST transaction most people will ever make in their life time. Realtors are trained ? and much of our training is in Real Estate Law to protect our clients from shady deals. I have had to go to court to help many people who were taken advantage of because of bad real estate deals and the only ones I have ever went to court on is for clients whom did not have a Realtor.

This is too serious to not have your own Realtor. You should have a Realtor for every single real estate transaction. Your Realtor should be as close to you as your banker. That is a relationship you should develop and keep.

If the Realtor takes a contract to represent you for 6 months then let her do her job. If you want a new home. Tell her what you want and let her represent you. That is what you hired her for ? to help you get a new home. If you had intended it to be for one offer ? then why did you lead her to believe you would give her 6 months.

You signed the contract ? therefore she has every reason to believe you are her client and its her job to represent you on any transaction you do within those 6 months. Why wouldn?t you want her to serve you. The builder?s agents represent the builder ? not you. You should never go into a home purchasing situation and not have your own Realtor ? no more than you would go into court and use the other parties lawyers. Would you?

Finally, I urge you to take advantage of the skills the Realtor has. Let her help you. Tell her what you want and let her do her job. There is no need for you to ever communicate directly with a seller. That is what you have her for. Sellers and Sellers agents have 100% more respect for clients with agents. And we really prefer to work with agents ? we really do. To some unscrupulous sellers taking advantage of you is always tempting and they can do so easily. And they laugh at how silly unrepresented buyers are. The temptation is removed when a Realtor stands between you and the seller.

A: The answer (based on the information you?ve given) is Yes, if you are already under contract on the new build ? then the buyer?s agency agreement is intact for this deal as well. If you are not yet under contract, you can most likely terminate the buyer?s agency agreement with her by sending a letter terminating the agreement. If she?s been a decent Realtor to you though, you may want to consider keeping her on through the new build process to help you through it. A: Unless the addendum stated that you were only being represented by the agent for that one specific transaction, then you have a valid contract in place for any home you build or purchase within the 6 month time frame.

Syria Agrees To Ceasefire During Eid Al-Adha Holiday, Peace Envoy Lakhdar Brahimi Says

BEIRUT (AP) ? The current international peace plan seeking to stop Syria's civil war suffered a major setback Wednesday when an al-Qaida-inspired militant group rejected a cease-fire proposed by the international envoy.

Lakhdar Brahimi, the U.N.-Arab League envoy for Syria, said the government in Damascus and some rebel leaders had agreed to a four-day truce during the Muslim Eid al-Adha holiday, which starts Friday.

The modest scope of the proposal reflected how short the international community is on ideas ? and even that appeared doomed. Both sides have agreed to previous, more ambitious cease-fires in the past only to break them, and neither side shows much interest in stopping the fight now.

The Syrian government denied it has made a decision, saying it is studying the proposal, and rebel leaders have expressed doubts.

An extremist group, Jabhat al-Nusra, which has joined the fight against President Bashar Assad, also rejected the truce.

"There will be no truce between us and the prideful regime and shedder of the blood of Muslims," the group said in a written statement posted Wednesday on militant websites. "We are not among those who allow the wily to trick us, nor are we ones who will accept to play these filthy games."

While the group is on the extreme edge of the rebel groups fighting in Syria, it also expressed a sentiment most of them share: that after 19 months of deadly violence, there is little faith that Assad's regime will abide by any agreement.

Brahimi told reporters in Cairo Wednesday that Assad's government had agreed to the truce and would issue a statement on the matter later "today or tomorrow." He did not say how it would be monitored.

Brahimi met with Assad in Damascus on Sunday after talks last week with opposition groups inside and outside Syria. He has said he received promises but not a commitment from them to honor the cease-fire.

Speaking by videoconference from Cairo on Wednesday, he told the U.N. Security Council that he hopes a temporary cease-fire in Syria can break the cycle of violence and allow a political transition to start, a U.N. diplomat in the closed meeting said.

He also said another failure would let the conflict worsen and spill over to other countries, the diplomat said, speaking on condition of anonymity because the meeting was private.

In Damascus, Foreign Ministry spokesman Jihad Makdessi said Wednesday that proposal was still "being studied" by Syrian army leaders and that Syria's decision would be announced Thursday.

Another opposition leader said he had little hope the truce would hold. Abdelbaset Sieda, head of the exile Syrian National Council, said opposition fighters have told him they are willing to adhere to it but will respond if attacked by regime forces.

"This regime, we don't trust it, because it is saying something and doing something else on the ground," Sieda said by phone from Sweden.

Brahimi's proposal is far more modest than a six-point plan by his predecessor as Syrian envoy, former U.N. Secretary-General Kofi Annan. A cease-fire was the centerpiece of Annan's proposal and was to lead to talks on a peaceful transition.

But the truce broke down soon after it started and the two sides returned to all-out war, although Annan said the regime was the main aggressor.

Violence continued around Syria Wednesday. A car bomb exploded in the Tadamon neighborhood of Damascus, killing at least eight people, said Rami Abdul-Rahman of the Britain-based Syrian Observatory for Human Rights.

Regime warplanes struck the village of Mar Shureen near a strategic rebel-held town in the country's north Wednesday, killing five members of an extended family, activists said.

The village is just outside the town of Maaret al-Numan, about a mile (nearly two kilometers) from a Syrian military camp that has been the site of fierce fighting for several days.

Opposition fighters seized Maaret al-Numan, which lies along the main highway between Aleppo and Damascus, earlier this month. That has disrupted the ability of Assad's army to send supplies and reinforcements to the northwest where troops are bogged down in a stalemate with the rebels in Aleppo, Syria's largest city.

Syria's uprising started in March 2011 with anti-regime protests. The conflict has since turned into a civil war. Anti-regime activists say more than 34,000 have been killed.

He is bombing the people at the bakery. "

Syria restricts access to foreign reporters and the authenticity of the video could not be independently confirmed.

After stunning NLCS exit, Cardinals try to regroup

ST. LOUIS (AP) - Kyle Lohse got to bed at 5:30 a.m. after the St. Louis Cardinals' flight following a most unpleasant end to the NL championship series against the San Francisco Giants.

Fatigue only added to the aftershock of a spectacular nosedive as players cleaned out their lockers Tuesday at an empty stadium still adorned with bunting. The pitcher's mound and home plate area were also covered in anticipation of a World Series opener that won't take place in St. Louis.

It might be the end of the line with the Cardinals for Lohse, who confessed to being a bit "delirious" from lack of sleep while discussing his future.

The rotation is full if Jaime Garcia rehabs successfully from a shoulder injury, with Adam Wainwright, Chris Carpenter, Lance Lynn and Jake Westbrook under contract.

Given a choice, Lohse would like to stay put.

"Yeah, definitely," he said. "It's been a great place for me. A lot of teams just try to be competitive, but this organization is all about trying to win another ring."

Then he added, "It's a business. It's a fun game, but a business. I haven't heard anything here, so that doesn't sound good."

The 34-year-old Lohse is in a much better spot than in 2008, when he bided his time by throwing to college hitters early in spring training before signing a one-year deal with the Cardinals in March. He didn't make it to free agency after that season, getting a four-year, $41 million extension in late September.

This time he is coming off his best season, going 16-3 with a 2.79 ERA. Wherever he ends up, Lohse stressed that he wants to play for a winning organization.

"I'm not going to be obviously jumping at the first offer out there," Lohse said. "It's too early right now because I don't know which teams are interested, and obviously I haven't heard from anybody.

"It's got to be a good situation."

Nearly everyone else will return next year for another try. They will need a while to purge the awful taste of blowing a 3-1 series lead to the Giants and missing a chance to defend their World Series title.

The handful of players who showed up during the time reporters were allowed in the clubhouse on Tuesday tried their best to accentuate the positive. Center fielder Jon Jay had empathy for the Washington Nationals, who seemed to have the Cardinals right where they wanted them before coughing up a 6-0 lead in Game 5 of the NL division series, and the Rangers, who were on the verge of closing out the World Series in six games last year.

St. Louis manager Mike Matheny spent much of the day, along with the coaches, meeting with the front office. Matheny and general manager John Mozeliak are likely to address the season later in the week.

"It's tough to swallow, but in baseball that's the way it goes," Jay said. "We were on the other end of the stick last year. It was a great ride, and now we know what it feels like."

The Reds do, too. Cincinnati had a 2-0 advantage over the Giants in the NL division series and lost the final three games at home.

"I don't know if it's harder to take," Cardinals outfielder Matt Holliday said Monday night after the Game 7 loss. "I think everybody in here wishes it ended differently, but they have a great team. The Reds had them that way, too. They're better than us."

Before coming up empty in Game 7 of the NL championship series, the Cardinals had tied a major league record with six straight victories in elimination games.

After taking a 3-1 series lead, Cardinals players spent time on the podium answering questions from media members who already had them penciled into the World Series about why their organization has been so productive. Then they fell apart, getting outscored 20-1 the last three games to become the 12th team to blow a 3-1 lead in a best-of-seven series.

They batted just .190 with 27 strikeouts in the three losses, committed four errors, and were 1 for 21 with runners in scoring position. Starters Chris Carpenter, Lance Lynn and Lohse gave up 14 runs in 9 2-3 innings, and allowed Giants pitchers to drive in three runs.

Lohse got the hook after retiring just six batters in Game 7.

"I know in that situation he's got to pull the trigger quick," Lohse said. "It was just unfortunate the way it kind of snowballed on us. Little things, you look at the broken bats, the choppers off the plate.

"Sometimes you just get the short end of it."

The middle of the lineup was a trouble spot in the NLCS.

Allen Craig's .400 average with runners in scoring position led the majors, but he was just 3 for 24 with two RBIs. Holliday hit .200 with two RBIs while bothered by a back injury that sidelined him one game. David Freese, the NLCS and World Series MVP last fall, batted .192 with a homer and two RBIs. Yadier Molina batted .393, but 10 of his 11 hits were singles and he had just two RBIs.

They stewed over all of the failures on the red-eye flight home.

"The last three games happened fast, and they really came out swinging the bats and pitched really well and played great defense," Craig said. "We kind of didn't do any of those very well."

Right after absorbing his third Game 7 loss, with three organizations, outfielder Carlos Beltran kept it in perspective.

"You want to get to the next level but sometimes that doesn't happen, so you have to understand that this game is like that," Beltran said. "As long as you go out there and give your best and try to do the best for the team, that is what's important."

(AP) ? Britney Spears' ex-manager described from the witness stand Wednesday a scene of domestic warfare, saying the superstar's father chased him around a kitchen, punched him and threatened his life.

Sam Lutfi, who is suing Spears' parents for defamation, testified while they watched from across the courtroom.

He denied accusations made in a book by Lynne Spears that he was a Svengali who became the gatekeeper of her daughter's world, locking her parents out of her life.

He contends he was a benevolent caretaker who protected Britney during her highly publicized meltdown.

Lutfi's direct testimony concluded in dramatic fashion as he was overcome by tears while describing the aftermath of the publication of the book.

"After the book came out, there was a huge spike of death threats that were pretty bad," he testified. "People I know were shunning me. Websites were created to kill me. People wished I was dead. People wished my family ... "

He didn't finish the sentence because he was crying.

"How did it make you feel," asked his attorney, Joseph Schleimer.

"Depressed, anxious and suicidal," Lutfi testified.

Lutfi told of days leading to Britney's hospitalization at a psychiatric unit, and jurors saw a video of the star ordering him around outside her home hours before she was taken away.

She was demanding that he let her drive her car and told him to get in the passenger seat. The scene outside her home was surreal, with TV lights and paparazzi surrounding her.

Lutfi said Britney feared her father Jamie Spears and fled her home when she heard he was coming. Lutfi said the father confronted him twice and punched him on the second visit.

"Jamie came barging into the house. He lunged at me and chased me around the kitchen island. He was spitting, yelling, shouting at me, and said I had hurt his daughter and he was going to beat the hell out of me and I'd better get out of the house," Lutfi testified.

After 10 minutes, he said, Jamie Spears was escorted out by security guards. But the next morning, he got into the house again and the battle resumed, Lutfi said.

"He cornered me in the kitchen, punched me in the solar plexus and threatened to kill me," Lutfi testified.

"How did it feel?" Schleimer asked.

"It hurt," Lutfi replied.

Asked what he did, he said, "I ran to the game room and locked myself in."

A lawyer for Spears said in opening statements that the father never physically assaulted Lutfi and merely touched him on the chest.

With Schleimer reading excerpts from Lynne Spears' book, Lutfi methodically denied every one of her accusations.

"Were you in complete control of Britney's life?" Schleimer asked.

"No," Lutfi said firmly.

"Did you attempt to keep Britney's family away?" he was asked.

"To the contrary, sir," Lutfi answered.

He denied cutting wires to phone lines in the house and hiding Britney's cellphones. He also said he never drugged the superstar.

Court proceedings ended for the day and were set to resume Thursday.

Lutfi is suing for damages for defamation and for a 15 percent share of the millions of dollars Britney made while he was with her.

The singer remains under the conservatorship of her father and has been told by a judge not to attend or testify in the trial.

She has made a remarkable comeback from her hard times, now acting as a judge on TV's "The X Factor."

    Berdych wins sixth spot in London fieldTwo spots remain - in theory - for the eight-man year-end championships after Czech Tomas Berdych made it into the field as the sixth qualifier following his Stockholm Open title.

    The former Wimbledon finalist will be playing the eight-man season wrap for the third time, joining a short list which includes Roger Federer, Novak Djokovic, Andy Murray, Rafael Nadal and David Ferrer.

    But Nadal is the joker in the pack with growing indications that the injured Spaniard will not be recovered from the knee injury which has kept him off the courts for four months. His possible target dates for a return are all over the calendar, but most centre on the 2013 season.

    Berdych will have a busy coming month on his plate with the Paris Masters, London World Tour Finals plus a November 16-18 Davis Cup final at home in Prague against Spain - almost certain to be without Nadal.

    "London is always a goal every season," Berdych said. "You have to play well the whole year to qualify. It will be special for me to play there for the third year in a row."

    Berdych beat Jo-Wilfried Tsonga, another London contender with the season in its final two weeks, dulling his qualifying chances only slightly.     6 SEO Lessons from PubCon Las Vegas 2012 - E-Web Marketing

    It?s been nearly a week since PubCon, and it?s time to review all the cool stuff we learned. This is definitely not a comprehensive list of everything that happened at PubCon, as I can only be in one place at a time while exciting things might be happening in the next room. Nonetheless, here?s the 6 biggest SEO-related takeaways I got from attending this excellent online marketing event.

    ?#1 Being too popular in Google+ Local may cause your neighbours? listings to disappear

    It might be an issue if you are too popular on your social media channels: Your neighbours will hate you. Michael Dourausch, a Los Angeles based Chiropractor accidentally discovered this when he invited 85 people from the SEO industry to his house. Of course, being online marketers, the 85 guests ?checked in? to all their social accounts. Later on, Michael found that his Google Places listings trumped every neighbouring business ? even those businesses that were in different niches disappeared altogether.

    The lesson here is that if you?re a local business, engage with your customers so they will check in to your place of business. Do some research first to segment them into social network categories: are they more likely to use Foursquare, Google or Facebook? Are they iPhone or Samsung fans? Do they use Gmail, Yahoo or Hotmail? Once you identified the segments, you can start engaging your audience through their favourite channels with the aim of increasing your social media activity. Especially check ins, which as the story above illustrates, is a very important local search ranking factor.

    #2 Seer Interactive?s ?How do they make money? interactive graph cost $10K to build

    The popular interactive app ?How do our favourite tech companies make money?? that Seer Interactive created set them back $10k! That?s a lot of money to throw into one link baiting campaign.

    It turns out that Seer Interactive didn?t just throw some money and hope for the best ? the app came about after thorough keyword research. Wil Reynolds from Seer Interactive explained that the purpose of keyword research is to understand a customer?s journey, time the market, and influence merchandising departments to start selling products that matter to searchers. In his research, Wil identified that searchers had a particular interest in how others make money, and no one had anything interesting to say about it!

    With this information, Seer Interactive invested in unique and innovative content to answer this question. As a link baiting campaign, the performance was exceptional: 8.3K Facebook Likes, 5,805 Tweets, 512 Google Plusses, 407 referring domains and 6,759 backlinks from high authority places like wired.com and thenextweb.com.

    The takeaway here is to find out what people want to know that nobody else is telling them ? and tell them in an interesting and engaging way. If executed well, this strategy is almost guaranteed to earn social interactions and high quality links.

    #3 More content does not necessarily mean better

    In his presentation on Link Building in the Age of Penguin, Jim Boykins, Founder and CEO of Internet Marketing Ninjas, gave a list of indicators that might categorize a website being at high risk for Penguin-related rankings setbacks:

    User experience related indicators

    • More than 80% of your traffic comes from Google
    • You have very few returning visitors
    • Your user experience is not great i.e. high bounce rates
    • No one searches your brand name

    Link related indicators

    • Bought links
    • Bought low quality blog reviews
    • Lots of article syndication
    • Too much exact match anchor text

    Content related indicators

    • You have thousands of pages, but not thousands of links pointing back to you.
    • You have thousands of pages, but only a few pages that have links from other sites

    His findings on content makes a lot of sense since we know Google still has difficulty identifying quality content via semantic recognition. The hint of very few links pointing back to a mega website seems to be a very good indicator for Google that something is wrong with the content.

    So the lesson? Jim recommends only making the website as big as you can support. Big is not always better.

    #4 Followerwonk + Tagcrowd = Win

    One of the surprises was Adam Melson?s presentation where he gave us a little trick in link building by using what you?ve already have. The prerequisite would be to have an active Twitter profile. By using Followerwonk, a tool which conveniently scrapes all the bios of your Twitter list, and then throwing the list into Tagcrowd, you will have a clear picture of what your followers are interested in. Gives you a good idea of what you can write for your next blog post, or maybe offer them a discount on the things they like.

    ?#5 Authorship is BIG

    Everyone seemed to be talking about Google Authorship at PubCon. There was even a whole session dedicated to Authorship and author tags. As Jim Boykins mentioned during his presentation, Google already knows a lot about you. Where you?ve written and what you?ve written, as well as your social media accounts. Google author tags is just another way for Google to organize all these pieces of information together.

    The takeaway is to know who your content writers are. Hire an expert writer to help you if you aren?t a great writer yourself. Also be mindful of what authors are linking back to your content, as these will all be possible ranking factors in the future when the AuthorRank algorithm is fully operational. And of course, a big NO for mass produced content and sending the same content across a large network to get links ? that doesn?t work anymore.

    #6 Everyone is Screaming Frog

    The website crawling tool Screaming Frog probably got more advertising space than any of the software vendors at the event ? and the people who work for the company didn?t pay for any of it. A lot of speakers had a strong preference for this tool, to the extent that they were willing to spend their precious time praising it. Nothing speaks better than having some of the best SEOs in the world talking up your product for FREE.?The SEOs at E-Web Marketing love Screaming Frog too, and never conduct a website audit without it.

    Shahid Awan from Cheapflights.com listed a few uses for Screaming Frog that go beyond the basics:

    • Product releases
    • Internal linking audits
    • Checking status error codes
    • Conducting Google Webmaster audits
    • Competitor audits
    • Creating link building opportunities

    This lesson here is to make a product so outstanding that industry leaders use it and tell their followers about it. You?ll definitely get links and popularity that way!
