Tom Cruise's attorney, Bert Fields, demands that the National Enquirer and its parent company, American Media, retract its new cover story about the actor's just-settled divorce from Katie Holmes or face a defamation complaint of epic proportions.

Among other tawdry allegations, the magazine claims Cruise's home was akin to a "house of horrors" and that his estranged wife, Holmes, lived a "tortured life" in a marriage that was a "living nightmare" in virtual lockdown for years.

Taking the Questions

Fields absolutely went OFF on what he said was a "disgraceful and lurid cover with its bogus, red and yellow headlines announcing one cruel lie after another about Mr. Cruise" and went on to take them apart one by one:

"Contrary to your headlines, Mr. Cruise has not engaged in any 'abuse' or 'humiliation' of Katie Holmes," he wrote. "Nor has he ever subjected her to any punishments."

"It is also completely untrue that Mr. Cruise ever subjected his wife to relentless verbal abuse, emotional punishment, humiliation and intimidation."

"These are all egregious lies. He did none of these things."

Regarding the "house of horrors" charge, Fields called Cruise's residence in Telluride, Colo., a "pleasant and loving home" for Tom, Katie and Suri Cruise.

"Suri was not forced to stay for five months in a tiny windowless room," he added, addressing another bogus allegation made by the tabloid.

He also rejected a claim that a "so-called 'expert'" told the Enquirer that Cruise "displays many of the symptoms of a man who beats up his wife."

Fields demanded an immediate retraction for "each and every one of the false assertions," which could cause Cruise "hundreds of millions" in damages.

Yesterday, a report leaked that Holmes secretly plotted her escape from Cruise with the use of burner phones; this article is entirely separate.

UPDATE: The story, a copy of which was leaked to The Hollywood Reporter but has yet to be published in print, was never meant for publication or dissemination and won't be released, according to the celebrity gossip tabloid.

Updated: 4 sophisticated U.S./Mexico border drug tunnels discovered

TIJUANA, Mexico (AP) ? Four drug smuggling tunnels equipped with lighting and ventilation ? including one with a railcar system ? have been discovered along the U.S.-Mexico border in less than a week, the latest signs that cartels are building sophisticated passages to escape heightened detection above ground.

Three of the tunnels were incomplete, including one that the Mexican army found in a Tijuana warehouse Thursday with more than 40 tons of marijuana at the entry. The passage extended nearly 400 yards, including more than 100 yards into the United States.

Soldiers found the Tijuana warehouse with four moving trucks full of marijuana, a trailer full of dirt, pickaxes, wheelbarrows, drills and other excavation equipment. The tunnel was equipped with a railcar system.

The Mexican army said three people were detained.

It was the second, major incomplete tunnel discovered in the San Diego-Tijuana area in two days and the third along the U.S.-Mexico border since Saturday, when a completed passage was found in a vacant strip mall storefront in the southwestern Arizona city of San Luis.

The 240-yard tunnel in Arizona showed a level of sophistication not typically associated with other crude smuggling passageways that tie into storm drains in the state.

Another incomplete tunnel in Arizona, found Friday in Nogales, did not appear to be in use, said U.S. Immigration and Customs Enforcement spokeswoman Amber Cargile. The investigation into that passage was ongoing and no arrests have been made, she said.

"When you see what is there and the way they designed it, it wasn't something that your average miner could put together," said Douglas Coleman, special agent in charge of the Phoenix division of the Drug Enforcement Administration. "You would need someone with some engineering expertise to put something together like this."

As Thursday's massive pot seizure in Tijuana demonstrates, tunnels have become an increasingly common way to smuggle enormous loads of heroin, marijuana and other drugs into the country. More than 70 passages have been found on the border since October 2008, surpassing the number of discoveries in the previous six years.

More than 150 secret tunnels have been found along the border since 1990, the vast majority of them incomplete, according to U.S. Immigration and Customs Enforcement. Raids last November on two tunnels linking San Diego and Tijuana netted a combined 52 tons of marijuana on both sides of the border.

The first Arizona tunnel was discovered after state police pulled over a man who had 39 pounds of methamphetamine in his vehicle and mentioned the strip mall.

The tunnel was found beneath a water tank in a storage room and stretched across the border to an ice-plant business in the Mexican city of San Luis Rio Colorado. It was reinforced with four-by-six beams and lined with plywood.

Investigators believe the tunnel wasn't in operation for long because there was little wear on its floor, and 55-gallon drums containing extracted dirt hadn't been removed from the property.

Coleman said investigators can't yet say for sure if the tunnel, estimated to cost $1.5 million to build, was operated by the powerful Sinaloa cartel. Still, authorities suspect cartel involvement because the group from Sinaloa controls smuggling routes into Arizona.

"Another cartel wasn't going to roll into that area and put down that kind of money in Sinaloa territory," Coleman said. "Nobody is going to construct this tunnel without significant cartel leadership knowing what's going on."

On Wednesday, the Mexican army found an incomplete tunnel in Tijuana estimated to be more than 150 yards long, beginning inside a building that advertised as a recycling plant. .

The Mexican army said two tractor-trailers were found inside the building, along with shovels, drills, pickaxes, buckets and other excavation tools. The walls were lined with dirt and wide enough for one person to get through comfortably.

U.S. authorities were investigating the tunnel discovered Wednesday for three months, said ICE spokeswoman Lauren Mack.

It takes six months to a year to build a tunnel, authorities say. Workers use shovels and pickaxes to slowly dig through the soil, sleeping in buildings where the tunnels begin until the job is done. Sometimes they use pneumatic tools.

The tunnels are concentrated along the border in California and Arizona. San Diego is popular because its clay-like soil is easy to dig. In Nogales, smugglers tap into vast underground drainage canals.

San Diego's Otay Mesa area has the added draw that there are plenty of nondescript warehouses on both sides of the border to conceal trucks getting loaded with drugs. Its streets hum with semitrailers by day and fall silent on nights and weekends.

Why deal with "a ruthless business cartel" ?

Now, after five months, Art says he still stands behind that view. While the 'cartel' wielded a bloody blow to the Sonics, that same business structure is a needed, powerful player in helping the arena's investors bring men's pro basketball back to Seattle. ?

Art says, "This is going to take three to four to five years (to secure an N.B.A. franchise if the arena plan is approved). The community will have a net benefit of being associated with the N.B.A. and the N.H.L., and having a venue that is going to bring...other benefits," he says.

It's not the same ol' N.B.A.

Art says recent changes make the N.B.A. a different beast today than the one that oversaw the Sonics departure. During the recent N.B.A. lockout, he says, some rules changed in favor of the owners of smaller-market teams. Art says the collective bargaining agreement that came out of the 2011 lockout means teams that are well-run have a better chance ?to break even, especially with changes to player salary caps.?

"They managed to reign in some of the ridiculous salaries to be slightly less ridiculous."

FDA unveils safety measures for opioid painkillers

WASHINGTON (AP) ? Drugmakers that market powerful painkiller medications will be required to fund training programs to help U.S. doctors and other health professionals safely prescribe the drugs, which are blamed for thousands of fatal overdoses each year.

The safety plan released by the Food and Drug Administration on Monday is designed to reduce misuse and abuse of long-acting opioid pain relievers, which include forms of morphine, methadone and oxycodone. The agency's plan mainly involves educating doctors and patients about appropriate use of the drugs.

The FDA has issued a number of warnings on prescription pain relievers in recent years but with little effect. Inappropriate use of the drugs caused nearly 425,000 emergency department visits in 2009, according to government figures. The drugs were blamed for 15,600 deaths that year, up from 14,800 in 2008.

The FDA said companies that sell the drugs must offer two to three hours of training to prescribers, either for free or for a small fee. The courses will be designed by companies that provide continuing medical education for health professionals, not by the drugmakers themselves.

The agency wants companies to provide training to least 60 percent of the 320,000 U.S. prescribers of the drugs within three years of launching the programs. The programs, which will be vetted by FDA regulators, must be available by March 2013.

"Responsible physicians will welcome the education benefits provided by this program," said Dr. Lynn Webster of the American Academy of Pain Medicine.

In addition to training, drugmakers will be required to distribute safety brochures to patients explaining the risks of the drugs and instructions to seek emergency care in event of an overdose.

The FDA spent more than three years developing the so-called risk management plans for the drugs, with input from industry and health care professionals.

Some health care experts stressed that training should be required for all prescribers. But FDA officials said the programs will be optional for now because making them mandatory would require a new law by Congress.

The new FDA plan covers about 30 opioid drugs, including Purdue Pharma's OxyContin, Johnson & Johnson's Duragesic patch and Pfizer's Embeda. Opioids are drugs that simulate the effects of natural narcotics, such as the opium poppy. They are typically prescribed for people already taking pain medications, including cancer patients, to treat severe pain flare-ups.

The products targeted by the FDA feature extended-release formulations designed to give long-lasting effects. But that potency carries serious risks when doctors prescribe them inappropriately, and when patients abuse them as stimulants.

The FDA reports that many physicians prescribe the painkillers for patients with migraine headaches, an unapproved use. Patients will also sometimes chew extended-release pills that are designed to be swallowed, causing an overdose.
