Samsung paid Kodak $550 million for a patent license - FOSS Patents

There a major imponderabilities in patent litigation. Companies that face the threat of an injunction or its ITC equivalent, an exclusion order (i.e., import ban) have tough choices to make. As a general trend, defendants now tend to stand their ground for much longer. For a long time, the vast majority of patent lawsuits in the United States got settled ahead of trial. Now there are more companies than ever that defend themselves not only against nuisance lawsuits (litigation brought by trolls that have weak cases and will settle for less than the cost of a proper defense) but also against serious attacks by large and well-known businesses.

Late on Friday, the ITC announced its determination to dismiss Eastman Kodak's digital camera patent action against Apple and BlackBerry maker Research In Motion. The trade agency's top-level decisions makers agreed with the Administrative Law Judge (ALJ) in charge of the investigation that the accused RIM products and the iPhone?3G (an import ban on which would have had very limited impact on Apple's business at this stage) infringe claim?15 of U.S. Patent No. 6,292,218 on an "electronic camera for initiating capture of still images while previewing motion images", but they also agreed with the ALJ that this patent claim was invalid. Another ALJ had found that patent invalid before, but his decision was remanded and, after his resignation, assigned to another ALJ. The finding of invalidity has now been affirmed "on modified grounds".

The Kodak bankruptcy estate could appeal this decision to the Federal Circuit, and that may very well happen. But Apple is now in a strong position. So far it has only incurred legal fees, and if the Kodak bankruptcy estate wanted to settle now, Apple would probably pay only a very limited amount in order to avoid litigation over other patents and the uncertainties that come with an appeal.

It's a safe assumption that Apple's total bill for its "Kodak moment" is going to be a small fraction of the $550?million that its major rival in today's smartphone market, Samsung, coughed up for a patent license from Kodak in early 2010. But in all fairness, Samsung came under pressure that Apple never experienced in its dispute with Kodak.

On December 17, 2009, an ALJ made an initial determination that found Samsung to infringe two Kodak patents, the '218 patent that has now (but not back then) been held invalid and another one, U.S. Patent No. 5,493,335. Samsung's co-defendant was another Korean company, LG. And LG was so scared of the initial determination that it settled, for $414?million dollars, on the eve of that preliminary ruling. Two days after the ID, Samsung agreed to negotiate again, and a few weeks later, in January, the companies announced the conclusion of a royalty-bearing license agreement. This article, which was published much later, states the figure paid by LG as well as the $550?million that Samsung ended up paying.

Not only are companies now more willing to let cases go to trial but they're also ever less ready to back down because of initial determinations by ALJs. After an initial determination, there's a Commission review, and even the final ITC decision can be appealed to the Federal Circuit.

Kodak has claimed all along that it invented digital photography and therefore thinks it's entitled to substantial payments. I don't want to disparage or belittle what this once-great company did. It's sad enough how his business has gone down the tubes. But as far as that '218 patent is concerned, I can only say: good riddance!

If Apple, RIM, Samsung, LG and others had actually infringed some real technological creation by Kodak, such as some highly complex technology at the heart of the sensors that make cameras work, then I would accept, in principle, the notion that someone has to pay for it. But the '218 patent has nothing whatsoever to do with serious, hard-core technology.

For a point of reference, here's the wording of the relevant claim (claim 15), along with comments from me in brackets -- but if you have a hard time understanding it at first because of all the technical terminology, just skip to my explanation:

An electronic still camera for initiating capture of a still image while previewing motion images on a display, comprising:

  • (a) an image sensor having a two-dimensional array of photosites covered by a mosaic pattern of color filters including at least three different colors for capturing images of a scene, each captured image having a first number of color pixel values provided in a first color pattern; [this is just one of the characteristics, so the patent doesn't cover all image sensors of this kind]

  • (b) a motion processor for generating from the captured images, a second number of color pixel values provided in a second color pattern having at least three different colors and representative of a series of motion images to be previewed, the second number of color pixel values being less than the first number of color pixel values, and the second color pattern being different from the first color pattern;

  • (c) a color display for presenting at least some of the motion images of the series of motion images corresponding to the captured images of the scene, the color display having an arrangement of color display pixels including at least three different colors in a pattern different from the first color pattern;

  • (d) a capture button for initiating capture of a still image while previewing the motion images presented on the color display; [all photo cameras have a capture button...]

  • (e) a still processor for generating a third number of color pixel values including at least three different colors representative of a captured still image; and

  • (f) a digital memory for storing the processed captured still image. [obviously any computer memory, such as the one found in smartphones, can store a "processed captured still image"]

While that patent claim mentions a lot of real technology, especially sensors, none of that was novel at the time Kodak filed for this patent. All of this was simply prior art that Kodak combined in a novel way. So what's the benefit of this particular combination?

The basic idea is that on the one hand you can have a low-resolution preview on a screen of a small device (be it a dedicated digital camera or a multifunctional smartphone), which is a "motion" preview because it is constantly refreshed as you move the device, and on the other hand you can then press a button and capture a high-resolution still image. That's it. The "invention" is that you take existing sensors, an existing capture button, an existing screen, and you show on the screen, in a low resolution, what you can capture in a high resolution. And you store it in memory, which is also none of Kodak's inventions.

But unless you have some legalistic reason for arguing non-infringement (for example, one of Apple's defenses had to do with the mechanism of actually capturing, arguing that newer iPhones didn't really capture the image only when the button is pressed but already had the higher-resolution version available in memory anyway), there wouldn't be a practical way to steer clear of infringement. The image that the user will ultimately get is always going to have a far higher resolution than the preview screen -- at least for all of the foreseeable future and certainly well beyond the expiration date of this patent (December?2014).

Distilled to its essence, this patent really made no contribution whatsoever to imaging technology. If this is the best patent that Kodak has (I doubt it, but it's what Kodak's lawyers apparently thought after the favorable initial determination in 2009), its creditors shouldn't expect it to extract much value out of its patent portfolio.

Now that I've criticized a patent that was asserted against Apple, I also want to mention that on Friday, the day of that ITC decision, I also criticized the inventive height (in technological terms) of Apple's "overscroll bounce", or "rubber-banding", patent. But the overscroll bounce patent was a brilliant idea resulting from outside-the-box thinking, even if there isn't any serious technology involved in making it work. Kodak's '218 patent, however, is a combination of pre-existing components that anybody would have combined in the same way since the preview screens of small devices simply don't offer as high a resolutions as the images that today's cameras generate.

Frugal Family Tree: Snyder of Berlin Chips 65th Anniversary Snyder ...

Chips are a summer food we always enjoy in my house. This year my son has loved to say "Chips" for some reason the word cracks him up. He will point to the cupboard and ask for chips with his lunch.


We had our chips as a snack during the afternoon while we played video games and watched cartoons. I really enjoyed the plain potato chips too. They had a great crunch and were not greasy. We served some with a clam dip for dinner with steak. It was a hit.

If Only Singaporeans Stopped to Think: Tackling preschool ...

IMPROVING Singapore's preschool environment can, over time, help to boost birth rates, reduce social inequalities and better prepare people for work in a knowledge economy.

These are some of the findings from a new report, Starting Well, published by the Economist Intelligence Unit and commissioned by the Lien Foundation. The research ranks the preschool environments in 45 countries. Singapore ranks 29th, below countries such as Chile (20th) and Greece (27th). The Nordic countries - Finland (1st), Sweden (2nd) and Norway (3rd) - are rated as having the world's most inclusive and high quality preschool environments.

Singapore's poor showing in the report has provoked debate. A closer look at the findings suggests areas for improvement.

The index scores countries across four categories: 'Availability' (25 per cent of total), 'Affordability' (25 per cent), 'Quality' (45 per cent) and 'Social Context' (5 per cent). Singapore performs well only in the social context, which looks at the broader socio-economic environment for young children, including their health and nutrition levels.

Singapore ranks 25th for availability, largely because there is no legal right to preschool education here. A legal right does not imply that it is mandatory, but simply that a government has an obligation to provide it to those who want it. The research argues that such a right is an important sign of a long-term, stable commitment to preschool. Indeed, there is a strong correlation between the presence of a legal right and overall index performance.

For instance, South Korea (ranked 10th) enacted its Early Childhood Education Act in 2004. Among other things, it stipulates that the government 'offers one year free early child education immediately before entering an elementary school, and requires the central and local governments to bear the cost for the free education'. By contrast, Singapore has no similar Act supporting the preschool sector.

Singapore ranks 21st in terms of affordability, pulled down by relatively low government preschool spending and insufficient subsidies for preschool providers.

Higher quality for all

FINALLY, Singapore ranks 30th in terms of quality, with low scores for, among other things, student-teacher ratios and preschool teacher wages.

While Singapore has some excellent preschools, they tend to be expensive. More affordable programmes, including those run by the National Trades Union Congress (NTUC) and the PAP Community Foundation (PCF), are of varying quality. As a result, children of richer parents typically receive a much better preschool education and are subsequently more prepared for primary school, with greater social awareness, confidence and group interaction skills.

'From neuro-scientific research, we understand the criticality of early brain development,' Professor Sharon Kagan, who teaches early childhood and family policy at Teachers College, Columbia University in the United States, explains in the report. 'Early childhood education contributes to creating the kinds of workforces that are going to be needed in the 21st century.' Google founders Sergey Brin and Larry Page, among others, have attributed their achievements partly to their good preschool education.

So, what can be done to improve the preschool environment here?

Raise teacher qualifications

FIRST, the research suggests that Singapore must raise minimum teacher qualifications. Experts agree that a well-trained workforce is the most important determinant of quality. Singapore last revamped its preschool teacher requirements in 2008, stipulating that from 2009, new preschool teachers must have five O-level credits and a two-year diploma in preschool education. (Before that, only three O-level credits and a teaching certificate were required.)

Though a good step, this progression is well behind the requirements of other countries. In Finland, for instance, all preschool teachers have a three- or four-year bachelor's degree in education. Greece, similarly, made the decision to turn kindergarten training into a graduate profession in the 1990s. Singapore must raise the bar aggressively while providing financial assistance to help current teachers retrain to meet the new requirements.

This adjustment has to be aligned with primary and secondary school requirements, and will have to be part of a broader push to raise the status and wages of all teachers in society. At the top end, preschool teachers in Denmark earn an average of nearly US$50,000 (S$62,800) a year in purchasing power parity (PPP) terms - compared with less than US$19,000 in Singapore.

According to the Ministry of Manpower, preschool teachers are the lowest paid profession within the 'Associate professionals and technicians' category, which includes, among others, social workers, display artists and dental nurses. The median gross monthly preschool teacher wage ($1,840) was just 63 per cent of Singapore's overall median gross wage ($2,925) last year.

Teacher shortage

SECOND, the research indicates a preschool teacher shortage in Singapore. The current student-teacher ratio here is 20 to 1, well above places such as Denmark (5.5), Canada (12) and Taiwan (12.6). Although there is some disagreement about what class size is optimal for better developmental outcomes, smaller classes are certainly more manageable for teachers.

While higher salaries should naturally attract more people to teaching, Singapore can also make strong efforts to attract qualified working professionals from other careers to transition into the profession, as Britain has done.

Greater parental awareness

THIRD, there is a need to bolster parental awareness and involvement in early childhood education. The top performing countries have extensive parental education programmes to ensure that parents understand the importance and role of preschool, and can provide a supportive home environment, including adequate social, emotional and motor-skills training that is 'age-appropriate' - matching the developmental level of children as they grow.

Other ways to improve quality include creating better links between preschool and primary school, and putting robust data collection mechanisms in place to enable more accurate preschool programme quality assessments.

Increase state spending

FINALLY, as these measures will result in higher costs, more public money will have to be spent. In terms of government spending per year on each relevant-age child, exact figures for Singapore are not available, but it is understood to spend less than Norway does (US$7,620 in PPP terms), and less also than countries such as New Zealand (US$4,329), Japan (US$4,029) and Poland (US$2,635).

Singapore's privatised preschool education sector is currently funded through subsidies given directly to families, who can then secure preschool places for their children - or a 'demand-side' approach. In some countries, subsidies are given directly to providers, with specific mandates about the need to accept all children - or a 'supply-side' strategy.

Singapore's limited supply-side support is highly targeted. It is offered only to non-profit providers with no ethnic or religious affiliations which have the ability and reach to provide services to all children, including those from low- to middle-income families. Currently, only the NTUC and PCF groups qualify for support, which is calibrated to help them keep their fees affordable.

While the Nordic countries have a nationalised, supply-side approach, the research shows that there are other countries, such as New Zealand (ranked 9th), that have achieved success with a private sector, market-led strategy, through subsidies both to providers and disadvantaged families.

A common assumption is that higher public spending on preschool will necessarily mean higher taxes and/or a diversion of public money from elsewhere. But a third way could be for preschool investment to come under deficit spending, with any possible tax hikes left for future generations, who are in any case the main beneficiaries. In other words, perhaps little children can pay for their own quality preschool when they grow up and start earning.

And yet they may not have to. According to the research, some studies suggest that preschool investment can yield annual returns ranging from 8 per cent to 17 per cent. These accrue partly to the children themselves - largely in the form of higher lifetime earnings - but more significantly to the wider community, in terms of a reduced need for later remedial education and spending, and lower crime and less welfare reliance in later life, among other things.

In many countries, preschool investment often forms part of a broader package of family support to increase female participation in the workforce and maintain birth rates.

The research also indicates that greater preschool availability, affordability and quality can help reduce social inequality. This is not only because parents can work more, but also because quality preschool better prepares children for primary school, improving educational and professional outcomes later on in life, thereby enhancing their future earning potential.

There is currently much debate in Singapore about how best to address social inequalities. One possible way is by giving all children, regardless of background, their best shot at life - starting from preschool education.

Smart stretchable super suit to fend off battlefield fatigue

The military?s futuristic research agency has awarded Harvard University researchers $2.6 million to develop a smart suit that could help improve the endurance of soldiers out in the field.

The proposed lightweight, efficient, and nonrestrictive suit would be made from soft wearable assistive devices that integrate several technologies pioneered at the university?s Wyss Institute for Biologically Inspired Engineering.

For example, a stretchable sensor would monitor the body?s biomechanics without rigid components that can interfere with motion. These sensors could detect the onset of fatigue.

What the suit will do when it knows its wearer is tired isn?t clear, though another technology envisioned for it would send out low-level vibrations that boost the body?s sensory functions. This could, for example, help a weary wearer maintain balance.

The suit differs from other super-soldier technologies such as the widely touted exoskeletons, which have large power requirements and are built with rigid components that can restrict mobility, the team notes in a news release.

Though the Defense Advanced Research Projects Agency is interested in the technology for military applications, similar technology could help increase the stamina of elderly people and improve mobility for people with physical disabilities.

(AP) ? Brandon Moss hit a game-ending RBI single with one out in the ninth inning to give Oakland another dose of late-inning dramatics as the Athletics beat the New York Yankees 3-2 on Friday night for their seventh win in eight games.

Yoenis Cespedes singled with one out in the ninth off Cody Eppley (0-1) for his fourth hit of the game and went to second on Jonny Gomes' infield hit. Moss, who left the bases loaded twice earlier in the game, lined a single to right field and Cespedes slid in safely ahead of Andruw Jones throw.

That gave Oakland its 10th walk-off win of the season and seventh in its past 14 home games, bailing out All-Star closer Ryan Cook (4-2), who allowed a game-tying homer to Robinson Cano in the top of the ninth.

The Yankees were completely silenced by Oakland rookie Tommy Milone, who struck out a career-high 10 batters in seven scoreless innings as the A's took a 2-0 lead.

But Oakland failed to build on the single runs scored in the third and fourth inning, squandering numerous scoring chances. The A's left the bases loaded in the first and seventh inning with Moss making the final out both times and stranded 12 runners over the first eight innings.

That helped the Yankees tie the game with a solo homer by Russell Martin off Jerry Blevins in the eighth and by Cano against Cook to lead off the ninth. Cook has four blown saves in 14 chances.

Milone allowed seven hits and no walks and tied an Oakland record with his 10 strikeouts against the Yankees. He also helped end New York's streak of 43 consecutive games with at least three runs ? the longest in the majors since Cleveland's 48-game run in 1994.

The first two game of this series have been a far cry from New York's first visit to Oakland in late May when the Yankees overwhelmed the A's in a three-game sweep to extend their winning streak at the Coliseum to nine games. That was part of a nine-game overall losing streak for the A's, who have recovered since then to post the second best record in the majors to the Yankees since June 2.

A pitching staff that leads the American League in ERA this season is the biggest reason for the recent success that has Oakland (49-44) five games over .500 for the first time since April 2010 and only a half-game out of a wild-card spot.

After leaving the bases loaded in the first inning, the A's struck for single runs in the third and fourth innings against Ivan Nova. Coco Crisp led off the third with a triple and scored on Jemile Weeks' sacrifice fly. Moss and Brandon Inge then hit back-to-back doubles to open the fourth to make it 2-0.

Jarrod Parker (6-4) makes his first career start against the New York Yankees on Saturday against Phil Hughes (9-7).

Stocks extend earnings-driven rally

Stocks extended their recent rally Thursday, even as a weak reading on the labor market underlined the headwinds facing the economy's recovery.

The S&P 500 index was on track for a third day of gains, after Wednesday's advance took it to its highest level since May. The rally has largely been driven by corporate earnings, and investors were cheered by IBM 's move to raise its full-year profit forecast late on Wednesday.

In economic news, jobless claims rose more than expected in the latest week, the latest in a string of data pointing to weakness.

"The labor market is clearly not recovering," said David Carter, chief investment officer at Lenox Wealth Advisors in New York. "We don't expect employment to recover strongly anytime soon."

Still, futures remained in positive territory after IBM's rosier full-year forecast, which bucked a recent trend of tech companies - such as Intel Corp and Qualcomm Inc - lowering their outlooks. Analysts feared the reduced views could have negative broader implications as the sector is considered a proxy for business spending. Shares of Dow component IBM rose 2.5 percent to $193 in premarket trading.

The S&P is on track to notch a third straight day of gains on Thursday, having advanced 1.4 percent over the past two sessions.

Investors have been concerned that the debt crisis in Europe and signs of slowing growth worldwide would hurt corporate profits, but thus far, most companies have beaten the recently moderated expectations of analysts. With 10 percent of the S&P 500 having reported, according to the latest Thomson Reuters data, 73 percent have exceeded expectations.

"What IBM did, and what other companies are indicating, is that earnings will not be as poor as people felt was possible," said Rick Meckler, who helps oversee $2 billion as president of LibertyView Capital Management in New York.

"When you see earnings hold up in a weakening economy, that allows stocks to keep their momentum and suggests these companies could really advance when the economy picks up."

Shares of Morgan Stanley fell as quarterly revenue declined due to a slowdown in trading and deal-making volumes.

A pair of Dow components also reported. Travelers Cos Inc posted a profit that missed expectations while Verizon Communications Inc's revenue rose on strong subscriber additions, though the revenue was slightly below consensus estimates.

Weak economic data recently has amplified hopes the Federal Reserve would step in with measures to boost growth. On Wednesday, Fed Chairman Ben Bernanke repeated in congressional testimony the Fed's pledge to act if the economy needed it. Later in the day, the Fed's anecdotal Beige Book survey showed the economy is still struggling.

Nokia Corp also reported results, coming in with a loss that was narrower than expected and ending the quarter with more cash than investors had expected.

Wall Street rose on Wednesday, lifted by results from such bellwethers as Honeywell Inc , though shares of Bank of America Corp were sold off following results, which pressured financials.
