Vacation danger: Is cruise ship liable for perils on shore excursions?

A federal appeals court restored a lawsuit against Carnival Cruise Lines in the case of a 15-year-old passenger killed in the crossfire of a gang shooting on the island of St. Thomas.

A federal appeals court on Wednesday restored a negligence lawsuit against Carnival Cruise Lines in the case of a 15-year-old passenger who was killed by cross-fire during a gang-related shootout near a popular tourist beach in the US Virgin Islands.

The girl?s parents filed suit against the cruise company, claiming ship personnel should have warned the family that the area near Coki Beach on the island of St. Thomas had been the scene of violent criminal activities.

The case is potentially important because it could further define to what extent cruise ship companies ? part of a $29 billion industry ? may be held liable for criminal acts perpetrated on passengers exploring various ports of call.

With the increasing popularity of cruising, there are also increasing reports of cruise ship passengers on shore excursions being robbed and, sometimes, killed.

At issue in Chaparro v. Carnival Corporation was whether personnel on the Carnival cruise ship ?Victory? owed a duty to advise passengers of potential dangers in certain areas of the Virgin Islands.

According to the lawsuit, a Carnival employee suggested the family take a day trip to Coki Beach after the ship docked at St. Thomas on July 12, 2010. The suit says ship personnel knew or should have known about violent gang activity and high crime rates in various parts of the Virgin Islands ? including that a gang member?s funeral was set for that afternoon.

The family, from San Juan, Puerto Rico, did not participate in a Carnival-endorsed shore excursion. Instead, they made their own arrangements to travel from the ship to and from Coki Beach. The shooting happened during the return trip.

The family was riding in an open-air bus and encountered a traffic jam near the site of the gang members? funeral. As the bus waited on the road, a gun-fight broke out, according to court documents.

Passengers ducked. One gang member allegedly sprayed the bus with gunfire. That?s when the teen, Liz Marie Perez Chaparro, who was celebrating her quincea?era, was shot in the side.

An ambulance was called. It never arrived. Finally, the bus sped away to a hospital. The teen died in her father?s arms.

In federal court in Miami, Carnival argued that the lawsuit must be dismissed. ?Carnival stops at a multitude of ports all over the world. It cannot reasonably be expected to monitor or be aware of every single danger that may arise on any given street throughout a port city and beyond,? the company?s lawyers said in their brief.

?Imposing upon cruise lines a duty to warn of each and every danger that exists in its hundreds of ports of call stretches the traditional duty of care too far,? the lawyers said.

Lawyers for the family countered that Carnival knew that its passengers might visit Coki Beach, a popular tourist destination which was promoted by Carnival?s own excursions.

?It is well established that cruise lines such as Carnival have an obligation to warn of reasonably foreseeable risks that exist even beyond the gangplank,? the family?s lawyers said in their brief. They added that the duty to warn was not limited to passengers on the ship?s own shore-bound excursions.

A federal judge in Miami dismissed the family?s lawsuit in August 2011. He said the complaint did not offer enough evidence of negligence by Carnival officials to permit the case to proceed to trial.

The judge invited the lawyers to submit a new complaint with more evidence. Instead, they filed an appeal.

In reversing the Miami judge?s decision, a three-judge panel of the Eleventh US Circuit Court of Appeals in Atlanta said the complaint contained enough information to survive the motion to throw the case out and permit further investigation of the underlying facts.

?The facts alleged in the complaint are plausible and raise a reasonable expectation that discovery could supply additional proof of Carnival?s liability,? the appeals panel said.

The appeals court noted that Carnival had argued that Liz Marie?s death was unforeseeable, and that a company has no duty to warn of an unforeseeable danger.

But the judges added that the complaint charges that ?Carnival was aware of gang-related violence and crime, including public shootings, in St. Thomas generally and near Coki Beach specifically.?

The appeals court said Carnival?s lawyers could raise the issue of whether the danger was foreseeable later in the case in a motion for summary judgment or during a trial.

The appeals court action remands the case to the federal court in Miami.

Bill Clinton basks in spotlight, give rousing defense of Obama

CHARLOTTE, North Carolina (Reuters) - Former President Bill Clinton gave a rousing defense of President Barack Obama's handling of the weak U.S. economy on Wednesday and launched a detailed attack on Republican Mitt Romney in a speech that electrified the Democratic National Convention.

Folksy, long on detail and showing he is still a master orator nearly 12 years after he left office, Clinton gave a more cogent defense of Obama's actions as president than perhaps the current resident of the White House himself has given.

Obama, he said, should not be blamed for the poor economy he inherited in 2009 and has set the foundations for strong growth - if voters will give him more time and re-elect him on November 6.

"Listen to me now," said Clinton. "No president - not me, not any of my predecessors - could have fully repaired all the damage that he found in just four years."

The speech was vintage Clinton, and proof that despite a series of heart ailments that have not slowed down the 66-year-old, he still relishes the political limelight.

Frequently departing from his prepared remarks, Clinton painted Obama as a reasonable man prevented from creating more jobs and reducing the budget deficit by a Republican Party in the grip of its extreme right wing.

His speech, given shortly before the Democrats formally nominated Obama for a second term, was a reminder of the budget surpluses and job growth Clinton led in the 1990s during his two terms in the White House.

Whether it will be enough to help keep Obama in office is an open question. Obama finds himself in a vulnerable position with the U.S. jobless rate at 8.3 percent. Polls show a tight race between him and Romney. Obama addresses the convention on Thursday, and on Friday, the Labor Department will give a figure on the jobless rate for August.

If Americans "renew the president's contract," the economy will get better and "you will feel it," Clinton said.

"Folks, whether the American people believe what I just said or not may be the whole election. I just want you to know I believe it. With all my heart I believe it," he said.

Clinton received roaring applause from thousands of Democrats who jammed the convention hall in Charlotte, North Carolina. The cheers grew louder when Obama came on stage after Clinton's speech. Clinton bowed to the president and gave him a bear hug.

Republicans were unimpressed, saying Obama has not worked cooperatively with his opponents as Clinton once did. "President Clinton drew a stark contrast between himself and President Obama tonight," said Romney spokesman Ryan Williams.

The Democrats' most popular elder statesman, Clinton was an Obama adversary in the 2008 campaign when his wife, Hillary Clinton, lost the party's nomination to Obama. They have since patched up those wounds.

CHARM, PLAIN ENGLISH

Clinton began talking in TV's prime time and stretched way beyond it in an address of around 50 minutes that he softened up with Southern charm, mentioning unexpected details such as a reference to George Washington's false teeth.

"He was absolutely phenomenal. It was what we needed to put things in plain English so people understand. We couldn't have had a stronger message," said Kevin Muth, a Florida Democratic delegate.

Clinton claimed that in 52 years, Democratic presidents have generated more job growth than Republicans by 42 million to 24 million.

"When President Barack Obama took office the economy was in free fall. It had just shrunk 9 full percent of GDP. We were losing 750,000 jobs a month. Are we doing better than that today? The answer to that is yes," he said.

He gave point-by-point criticism of Romney and his vice presidential running mate, Paul Ryan, accusing Romney of wanting to overhaul government entitlement programs Medicare and Medicaid in a way that would reduce benefits for poor children and seniors, he said.

"If he's elected and he does what he promised to do, then Medicare will go broke in 2016," said Clinton.

Romney's criticism of Obama for allowing states to have waivers from work requirements in a welfare law Clinton signed is misplaced, said the former president.

His appearance followed a sometimes chaotic day at the convention, when Obama had to personally intervene to force back into the party platform language declaring Jerusalem to be the capital of Israel.

Democrats also scrambled to move Obama's Thursday night speech indoors. He had wanted to accept the Democratic nomination in an open-air stadium jammed with tens of thousands of supporters to portray an image of strength as he faces a tough re-election fight.

But the threat of thunderstorms from remnants of Hurricane Isaac forced convention organizers to switch the speech to a much smaller location, the Time Warner Cable Arena.

Other speakers lauded Obama for defending the rights of women, immigrants and gays and countered Republican arguments that he is anti-business.

But Massachusetts U.S. Senate candidate and former consumer crusader Elizabeth Warren gave an impassioned attack against corporate greed.

She criticized Romney's statement that "corporations are people."

"No, Governor Romney, corporations are not people," Warren said. "People have hearts, they have kids, they get jobs, they get sick, they cry, they dance. They live, they love, and they die. And that matters," Warren said.

I experimented today with Ham and Potato soup the best thing was it cost me nothing, I only used what was in the house and it didn?t cost me anything extra. It was also easy to do and since I was sick today it was perfect.

Easy Ham and Potato Crock-pot Soup
Serves 6

I love getting Ham and Potato soup when I go out to eat and went on the search for an easy recipe. Most of the recipes I found used ingredients I don?t keep on hand. I decided to step out on my own and just use what I had so it wouldn?t cost me anything.

Ingredients

  • Ham bone with ham on it ? leftover from dinner a few days ago
  • 12 medium sized potatoes ? bought at the beginning of the month and almost out of life
  • 4 cups water
  • 3 Tbsp chicken bouillon base
  • 2 1/2 cups of milk ? I used whole milk because I had some for my Father-In-Law but mixing up some powdered milk would work as well. This is normally what I do since we don?t drink milk.


In Crockpot put Ham bone, water, bouillon base, and potatoes (peeled and cut into chunks). Cook on high for 4-5 hours.

Before serving pull out ham bone and clean all meat off the bone and return to crockpot.

Pour in milk slowly and mix with hand mixer on medium till it is the texture you are looking for. (This is something you can have your kids help with, my son had fun)

To make it thinner you can add more milk or to make it thicker less milk. My family decided by tasting that this was the consistency they liked.

Serve into bowls and eat as is or top with cheese, onions, or bacon.

Spinach power gets a big boost: Reseachers combine spinach protein with silicon to make biohybrid solar cell

ScienceDaily (Sep. 4, 2012) ? Spinach power has just gotten a big boost.

An interdisciplinary team of researchers at Vanderbilt University have developed a way to combine the photosynthetic protein that converts light into electrochemical energy in spinach with silicon, the material used in solar cells, in a fashion that produces substantially more electrical current than has been reported by previous "biohybrid" solar cells.

The research was reported online on Sep. 4 in the journal Advanced Materials and Vanderbilt has applied for a patent on the combination.

"This combination produces current levels almost 1,000 times higher than we were able to achieve by depositing the protein on various types of metals. It also produces a modest increase in voltage," said David Cliffel, associate professor of chemistry, who collaborated on the project with Kane Jennings, professor of chemical and biomolecular engineering.

"If we can continue on our current trajectory of increasing voltage and current levels, we could reach the range of mature solar conversion technologies in three years."

The researchers' next step is to build a functioning PS1-silicon solar cell using this new design. Jennings has an Environmental Protection Agency award that will allow a group of undergraduate engineering students to build the prototype. The students won the award at the National Sustainable Design Expo in April based on a solar panel that they had created using a two-year old design. With the new design, Jennings estimates that a two-foot panel could put out at least 100 milliamps at one volt -- enough to power a number of different types of small electrical devices.

Harnessing the power of spinach

More than 40 years ago, scientists discovered that one of the proteins involved in photosynthesis, called Photosystem 1 (PS1), continued to function when it was extracted from plants like spinach. Then they determined PS1 converts sunlight into electrical energy with nearly 100 percent efficiency, compared to conversion efficiencies of less than 40 percent achieved by artificial devices.This prompted various research groups around the world to begin trying to use PS1 to create more efficient solar cells.

Another potential advantage of these biohybrid cells is that they can be made from cheap and readily available materials, unlike many microelectronic devices that require rare and expensive materials like platinum or indium. Most plants use the same photosynthetic proteins as spinach. In fact, in another research project Jennings is working on a method for extracting PS1 from kudzu.

Since the initial discovery, progress has been slow but steady. Researchers have developed ways to extract PS1 efficiently from leaves. They have demonstrated that it can be made into cells that produce electrical current when exposed to sunlight. However, the amount of power that these biohybrid cells can produce per square inch has been substantially below that of commercial photovoltaic cells.

Another problem has been longevity. The performance of some early test cells deteriorated after only a few weeks. In 2010, however, the Vanderbilt team kept a PS1 cell working for nine months with no deterioration in performance.

"Nature knows how to do this extremely well. In evergreen trees, for example, PS1 lasts for years," said Cliffel. "We just have to figure out how to do it ourselves."

Secret is "doping" silicon

The Vanderbilt researchers report that their PS1/silicon combination produces nearly a milliamp (850 microamps) of current per square centimeter at 0.3 volts. That is nearly two and a half times more current than the best level reported previously from a biohybrid cell. The reason this combo works so well is because the electrical properties of the silicon substrate have been tailored to fit those of the PS1 molecule. This is done by

implanting electrically charge atoms in the silicon to alter its electrical properties: a process called "doping." In this case, the protein worked extremely well with silicon doped with positive charges and worked poorly with negatively doped silicon.

To make the device, the researchers extracted PS1 from spinach into an aqueous solution and poured the mixture on the surface of a p-doped silicon wafer. Then they put the wafer in a vacuum chamber in order to evaporate the water away leaving a film of protein. They found that the optimum thickness was about one micron, about 100 PS1 molecules thick.

Protein alignment

When a PS1 protein exposed to light, it absorbs the energy in the photons and uses it to free electrons and transport them to one side of the protein. That creates regions of positive charge, called holes, which move to the opposite side of the protein.

In a leaf, all the PS1 proteins are aligned. But in the protein layer on the device, individual proteins are oriented randomly. Previous modeling work indicated that this was a major problem. When the proteins are deposited on a metallic substrate, those that are oriented in one direction provide electrons that the metal collects

while those that are oriented in the opposite direction pull electrons out of the metal in order to fill the holes that they produce. As a result, they produce both positive and negative currents that cancel each other out to leave a very small net current flow.

The p-doped silicon eliminates this problem because it allows electrons to flow into PS1 but will not accept them from protein. In this manner, electrons flow through the circuit in a common direction.

"This isn't as good as protein alignment, but it is much

better than what we had before," said Jennings.
