Union plans to challenge Fla. privatization plan

TALLAHASSEE, Fla. (AP) ? A long-running push by the administration of Florida Gov. Rick Scott to privatize thousands of prison jobs could soon be headed back to court, marking yet another constitutional clash for the Republican governor.

Florida's prison's agency has asked a legislative panel to approve spending nearly $58 million in order to privatize prison health care operations by January. The move could affect up to nearly 3,000 employees statewide.

But the union that represents state workers contends that the Legislative Budget Commission cannot legally make such a large change to the state's nearly $70 billion state budget. That role is left to the entire Legislature, said Tom Brooks, an attorney for the American Federation of State, County and Municipal Employees.

Brooks said the union will sue if the budget panel approves the privatization plan at its Wednesday meeting.

State legislators back in 2011 had previously approved the privatization effort but they tucked it into the overall state budget. That move sparked a court fight, but a judge this summer declared the case over because the outsourcing provision had expired at the end of the June. That's when the state's fiscal year ended.

"This is just a back door attempt to revive (the provision)," Brooks said.

Senate Democratic Leader Nan Rich, D-Weston, agrees with the union that the Scott administration and the legislative panel are overstepping their authority.

"It has a certain role, one of making limited adjustments in the budget, not creating a policy change," Rich said.

House and Senate leaders did not respond directly for comment on the lawsuit threat.

But the Florida Department of Corrections, pointing to another section of state law, contends it can move ahead with the privatization plan without legislative approval. The agency only needs the approval of the budget panel in order to pay for it.

Ann Howard, a spokeswoman for the department, says that if the state does not privatize its health care operations for nearly 100,000 inmates it will create a deficit in the state's prison budget by more than $60 million.

The agency says that the deficit will be lowered to about $6 million if the privatization plan goes ahead.

"This is common sense math," Howard said. "We have to be responsible. The choice is obvious."

The department already has selected two companies to handle health care services. The state picked Pittsburgh-based Wexford Health Sources for the southern part of the state and Corizon Inc. of Brentwood, Tenn., for other regions.

Who should replace Jose Aldo at UFC 153?

After Jose Aldo pulled out of his title defense with Frankie Edgar, the UFC was left without a main event in a fight card that is a month away. Who can fill in and face Edgar? Here are some possibilities.

Chan Sung Jung: "The Korean Zombie" is popular, an exciting fighter and will still have Brazilian fans excited to see a card that was decimated in just a few hours time. His last three fights have ended in stoppages, and his win over Dustin Poirier proved he's ready for big time.

Jimy Hettes: "The Kid" is undefeated and has shown he can pull out thrilling submission wins. He is scheduled to fight Marcus Brimage at UFC 152, but if there's anything this summer has taught MMA fans, it's that all fight cards are subject to change.

Godofredo Pepey: His fight record is not one that dictates main event status, but it's really, really fun to say Godofredo Pepey.

The capacity bump will come in PS3 system update v4.25, and once installed, you'll just need to head over to the Saved Data Utility under the XMB's Game column to see it. After leading the league in sacks last year, Vikings defensive end Jared Allen didn?t have a sack in Week One this year. But he thinks he would have if the regular officials were on the field.

Allen did bring down Jaguars quarterback Blaine Gabbert behind the line of scrimmage on one play, but the replacement officials working the game ruled that he had crossed the line of scrimmage prior to the snap. Allen believes he perfectly timed his jump, just starting to get out of his stance at the exact moment the ball was snapped, and the officials were wrong to flag him.

?I moved, but I didn?t think I broke the neutral zone before the ball was snapped,? Allen said in an interview on ESPN.

Allen said that he thinks he beat Jaguars left tackle Eugene Monroe so swiftly that the officials were caught off guard by it, and assumed that he must have had an unfair jump. Allen said he thinks the regular officials know about his fast first step and would have given him the sack.

?When a guy doesn?t move, I think it was his lack of movement ? the offensive lineman?s ? that made it look worse than it was,? Allen said. ?I think I?ve got a rapport with the other refs. They might have given me some leniency and let me get away with a tight call.?

For his part, Monroe thinks the refs were wrong too ? but wrong in the opposite direction. According to Monroe, not only was Allen offside, but the officials should have blown the play dead because Allen had an unabated path to the quarterback.

?He jumped offside and it was bulls?t,? Monroe told the Florida Times-Union. ?They should have stopped the play. That just shouldn?t happen. He knows better than to hit the quarterback in that situation. . . . I don?t remember hearing the whistle, but I know I saw a flag. To take a shot at the quarterback like that, especially a veteran player who understands the game, that didn?t start his day off with me on a good note.?

Monroe played well in protecting Gabbert from Allen, who didn?t have a single tackle all game. But to my eyes Allen is right: On the play in question, he timed his jump perfectly, and should have had a sack.

Magma Pooling Beneath Infamous Greek Volcano

Molten rock is pooling beneath Greece's Santorini volcano, the site of one of the largest eruptions in the past 10,000 years. That eruption, which took place about 3,600 years ago, wiped out the Minoan civilization of the Greek islands and may have spawned the legend of the lost city of Atlantis.

In the past 1.5 years, the magma chamber beneath the volcanic island has ballooned by as much as 350 million cubic feet (20 million cubic meters), or up to 15 times the size of London's Olympic Stadium. This giant mass of magma has caused the island to rise by as much as 5.5 inches (14 centimeters), according to a new study published yesterday (Sept. 9) in the journal Nature Geoscience.

This research follows reports earlier in the year of renewed earthquake activity beneath the volcano after it had been silent for the past 25 years. The reports have spurred concerns the volcano could erupt in the near future, but when that might happen is still unclear, researchers said in a statement.

"Before this work, we didn't really know how the volcano behaved during the periods of time between eruptions," David Pyle, an Oxford University researcher and study co-author, told OurAmazingPlanet. "Now, it looks as though the magma chambers beneath volcanoes like Santorini grow in spurts."

When the volcano erupted in approximately 1620 B.C., it created tsunamis 40 feet (12 meters) tall that destroyed much of the civilization flourishing in and around the Aegean Sea. Much of the previous island of Santorini was destroyed or submerged.From the air, the resulting?caldera, or volcanic crater, appears as a small cluster within the bigger collection of Greek islands in the Aegean Sea.

Earlier this year, global positioning system (GPS) sensors placed on the caldera detected renewed movement, measuring a series of small earthquakes. Seismic activity can trigger eruptions and are often a clue that a volcano may be preparing an outburst in the near future. But the connection is far from well-understood; and in the past few months, seismic activity has dropped off once again, according to the statement.

If the volcano did erupt, it wouldn't be likely to create nearly as much havoc is it did in the time of the Minoans, since it is much smaller today than it was in the past. But it's still important to keep an eye on the volcano, the researchers warn. ?[History's 10 Biggest Eruptions]

"Although Santorini is well known for its large explosive eruptions, these probably only happen every 20,000 years or so," Pyle said.

There has been much speculation as to whether the Santorini eruption inspired the legend of Atlantis, which Plato said drowned in the ocean. Although someexperts think the legend of Atlantis was just invented, others say the explosion might have given rise to the tale of a lost empire by helping to wipe out the real-life Minoan civilization that once thrived in the Mediterranean.
